The amendment package also identifies several corrections designed to address <br /> existing inconsistencies within the UDO related the regulation and development of utilities. <br /> Attachment 1 includes a synopsis of the comments made at the Quarterly Public Hearing. <br /> Attachment 3 contains an excerpt from the draft minutes from the August 27, 2012 Quarterly <br /> Public Hearing. Amend Section 5.9.6 (A) (1) (b) to establish limits for a solar array erected as an <br /> accessory use (i.e. staff review and approval) based on net-metering policies <br /> observed by local utility companies not to exceed 20 kilowatts. <br /> b. Allow for arrays with front yard open space areas outside of established setback <br /> areas. <br /> Staff has incorporated these modifications into the ordinance amendment package contained <br /> within Attachment 2. Attachment 4 contains the minutes for the Planning Board's September 5, <br /> 2012 regular meeting. <br /> Planninq Director's Recommendation. The Planning Director recommends approval of the <br /> proposed UDO amendments as contained within Attachment 2 based on the following: <br /> i. The amendments establish appropriate permitting thresholds and review criteria for solar <br /> arrays; <br /> ii. Previously identified inconsistences have been corrected; <br /> iii. The amendments are reasonably necessary to promote the public health, safety, and <br /> general welfare and to achieve the purposes of the adopted Comprehensive plan or part <br /> thereof; and, <br /> iv. The UDO amendments are consistent with the goals and policies of the adopted <br /> Comprehensive Plan. <br /> Procedural Information. In accordance with Section 2.8.8 of the Unified Development <br /> Ordinance, any evidence not presented at the public hearing must be submitted in writing prior <br /> to the Planning Board's recommendation. Additional oral evidence may be considered by the <br /> Planning Board only if it is for the purpose of presenting information also submitted in writing. <br /> The public hearing is held open to a date certain for the purpose of the BOCC receiving the <br /> Planning Board's recommendation and any submitted written comments. <br /> FINANCIAL IMPACT: See Section C.3 in Attachment 1. <br /> RECOMMENDATION(S): The Manager recommends the Board: <br /> 1. Receive the Planning Board's recommendation of approval; <br /> 2. Close the public hearing; and <br /> 3. Adopt the ordinance amendment contained in Attachment 2. <br />
