Benedict, AICP,Planning Director <br /> DATE: September 20,2001 <br /> RE: Schools APFO <br /> Attachments: Response to Community Housing Corporation <br /> Schools Adequate Public Facilities Ordinance <br /> Memorandum of Understanding <br /> Projections <br /> CAPS Allocation <br /> This memo serves as an update to the progress of the Schools APFO. Based on comments made <br /> during public hearing in Chapel Hill in May, 2001 and following correspondence from their <br /> attorney,Ralph Karpinos, a few issues regarding implementation and timing was brought <br /> forward. <br /> To address these operative and legal issues,the Attorneys,Planners, School Representatives <br /> (APS) subgroup of the Schools Land Use Councils was reconvened. Approximately five <br /> meetings have been held in May, June, July,August and September and one final draft session to <br /> be held on September 24. The attendance, at times,was weak due to the summer break that <br /> slowed the coalescence of the collective wisdom of the group. However, a general <br /> understanding of the group and redrafting of certain sections of the Memorandum of <br /> Understanding(MOU)by the attorneys has brought forth a document that addresses the issue of <br /> timing of Certificate of Adequate Public Schools (CAPS)to a reasonable conclusion. <br /> On this issue,the CAPS would be formally issued after the local government approves a <br /> development permit but before final recordation. Previously, the issuance was suggested much <br /> earlier in the process.
