subdivision. A 150-foot building setback easement on lots 164,165, and 166 8 <br /> shall be provided along Baldwin Road as indicated on the Preliminary Plan. <br /> 6 . A 20-foot wide pedestrian access easement shall be located in lot 191 along the <br /> northern property line next to lot 190 from the open space area to Fox Hill Farm <br /> Drive. <br /> 7. A recycling facility may be established on this property if an agreement is reached <br /> among the owner, the HOA and Orange County consistent with Orange County's <br /> Solid Waste operating policies. The open space area, located south of and adjacent <br /> to Lot 157 and north of Fox Hill Farm Drive in Phase 3, shall be reserved on the <br /> final plat and designated as a potential recycling facility. If an agreement is <br /> reached, the reserved area shall be conveyed to the HOA or Orange County. <br /> Maintenance of any property conveyed to the HOA or Orange County for a Fox <br /> Hill Farm community recycling center will be the responsibility of the HOA or <br /> Orange County as agreed to by Orange County and the HOA. The declaration of <br /> covenants shall be revised to provide for the recycling center and its maintenance. <br /> G. Certifications <br /> 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor <br /> shall be notarized on the face of the Final Plat. <br /> 2. A Certificate of Declaration and Maintenance in the form provided in Section V- <br /> D-6-b of the Orange County Subdivision Regulations signed by the landowner / <br /> developer shall be on the face of the plat and included in a document describing <br /> development restrictions to be recorded concurrently with the Final Plat. <br /> 3. The North Carolina Department of Transportation shall certify that Farm Gate <br /> Drive, Windflower Place, Lee Fox Lane, Fox Hill Farm Drive, Cedar Stone <br /> Way, Still Meadow Lane, Starfire Place and Springfield Place have been <br /> constructed to State standards or that construction plans have been approved <br /> prior to Planning Department signatures on final plat. <br /> 4. A Certificate of Approval signed by the Orange County Planning and <br /> Inspections Department. <br /> NOW THEREFORE BE IT RESOLVED by the Board of Orange County <br /> Commissioners that the Preliminary Plan for Fox Hill Farm Central Subdivision is approved in <br /> accordance with the above mentioned conditions and attached Preliminary Plat dated <br /> September 20, 2001.
