8. Fifth site inspection performed on November 6, 2001. Large sign back on Lot #30 <br /> (Biltmore Homes, LLC). <br /> 9. A Notice of Request for Assessment of Civil Penalties in Connection with a Continuing <br /> Zoning Violation was sent to the property owner via certified mail, return receipt <br /> requested, on November 9, 2001. A copy of the Notice of Zoning Violation was <br /> attached. The Request noted that civil penalties in connection with the violation would <br /> be assessed beginning on November 6, 2001. Notice received by property owner on <br /> November 14, 2001. <br /> NOW, THEREFORE, BE IT RESOLVED by the Board of Orange County Commissioners that <br /> Biltmore Homes, LLC own property in Churton Grove Subdivision, Phase I that is being used in <br /> violation of the Orange County, N.C. Zoning Ordinance and that this violation has been ongoing <br /> since July 9, 2001, and that each day's violation is a separate and distinct offense. Biltmore <br /> Homes, LLC are indebted to Orange County, North Carolina in the amount of $100.00 per day, <br /> beginning on November 6, 2001, for violation of Section 9.2 (Signs Not Subject to Permit <br /> Requirements), of the Orange County, N.C. Zoning Ordinance. <br /> Upon motion of Commissioner Margaret W. Brown, seconded by Commissioner Moses <br /> Carey, Jr., the foregoing resolution was adopted this the 19th day of November, 2001. <br /> 1, Beverly A.
