035 <br /> 1. Notification of Spills <br /> a) Notwithstanding other requirements of law, as soon as any person <br /> responsible for a facility or operation, or responsible for emergency <br /> response for a facility or operation has information of any known or <br /> suspected release of materials which are resulting or may result in illegal <br /> discharges or pollutants discharging into or may reach the stormwater <br /> collection system or waters of the Neuse River Basin in Orange County, <br /> said person shall take all necessary steps to ensure the discovery, <br /> containment, and cleanup of such discharge. In the event of such a <br /> discharge of hazardous materials, said person shall immediately notify <br /> emergency response agencies of the occurrence via emergency dispatch <br /> services, and shall notify the County within twenty-four(24)hours. In the <br /> event of a discharge of non-hazardous materials, said person shall notify <br /> the County no later than the next business day. All notifications shall be <br /> confirmed by written notice addressed and mailed to the County within <br /> three(3)business days of the discharge. <br /> b) Notification shall not relieve said person of. <br /> (1) any liability or expense related to the discharge. <br /> (2) restoration of any area affected by the discharge to preexisting <br /> conditions. <br /> (3) liability or violation of any regulatory body of the County, <br /> State or Federal government. <br /> Section 15 Inspections and Investigations. <br /> A. Site Inspections <br /> Agents, officials, or other qualified persons authorized by the County will periodically <br /> inspect on-site BMPs,protected buffers, and illegal discharges to ensure: <br /> 1. compliance with 9%-Aet—,this Ordinance, er-vales or-or-defs adopted or-issiaed <br /> P to uh&'; fflRdiffl.aflee. <br /> 2. whether the measures required in the plan are being constructed in accordance <br /> with the approved plan; <br /> 3. whether the permanent BMPs are in need of any maintenance including, but <br /> not limited to, the following: <br /> a) mowing of vegetation, <br /> b) vegetation re-establishment, <br /> c) tree removal (especially from wet detention ponds), <br /> d) stabilization of any eroding areas, and <br /> e) structural (pipe,riser, dam, etc) repair. <br /> B. Notice of the right to inspect shall be included in the letter of approval of each <br /> Stormwater Management Plan. <br /> C. Authority to Enter Property and Conduct Investigations and Inspections <br /> 29 <br />
