Geof Gledhill said that the Gateway Building would be build first, to be completed around <br />11107 with the library and office building coming on board around 5/08. He said that if <br />the interior design goes over the estimated casts, then Orange County would pay the <br />overage. <br />Chair Jacobs suggested Jeff Thompson, a construction manager with the County, review <br />the interior pricing first and all agreed this would be a good idea. Geof Gledhill said that <br />he would also address the library design issue with Mr. Horton and his attorney. <br />^ CMR will publicly advertise, pre-qualify and accept bids on a single prime basis <br />from licensed general contractors <br />^ The CMR will require the single prime general contractor to furnish 100°l° <br />performance and payment bonds which name the CMR's construction lender, the <br />CMR and Orange County as joint obliges. <br />^ The CMR will reserve the right to withdraw from the Project without penalty or <br />liability in the event the CMR determines, in its discretion, that the lowest <br />responsible, responsive bidder is nonetheless unacceptable to the CMR. <br />^ The proposed completion schedule was reviewed. <br />^ Other contingencies were reviewed such as approval by Weaver Street Market; <br />land use approvals by the Town of Hillsborough; satisfaction of construction loan <br />underwriting criteria by Horton lender; LGC and underwriting approval of debt <br />structuring of Orange County debt so that it complies with Orange County's <br />policies of 15°~ of General Fund Budget debt service payments and 7% annual <br />growth of General Budget Fund; and execution and delivery of Contract <br />documents mutually agreeable to the CMR, the single prime general contractor, <br />the contractor's surety, the CMR's construction lender and Orange County. <br />Geof Gledhill said that the next step would be to hold a public hearing on October 17tH <br />and also to make it a decision item so that he can begin to develop the contract with Mr. <br />Horton and his attorneys. <br />A motion was made by Chair Jacobs seconded by Commissioner Foushee to direct staff <br />to continue with negotiations, to flesh out costs, to engage Jeff Thompson to review <br />design costs, and when they are ready to move forward with the library design, to hire a <br />library design consultant to work with Jeff Thompson. <br />VOTE: UNANIMOUS <br />RECONVENE INTO REGULAR SESSION: <br />A motion was made by Commissioner Halkiotis seconded by Commissioner Foushee to <br />reconvene to Regular Session at 11:20 p.m. <br />VOTE: UNANIMOUS <br />12.
