APPROVED 6112!2007 <br />MINUTES <br />ORANGE COUNTY BOARD OF COMMISSIONERS <br />October 3, 2006 <br />The Orange County Board of Commissioners met on Tuesday, October 3, 2006, <br />Southern Human Services Center in Chapel Hill, North Carolina. <br />COUNTY COMMISSIONERS PRESENT: Chair Barry Jacobs, and <br />Commissioners Moses Carey, Jr., Valerie P. Foushee, Alice M. Gordon, and Stephen H. <br />Halkiotis <br />COUNTY COMMISSIONERS ABSENT: <br />COUNTY ATTORNEY PRESENT: Geoffrey Gledhill <br />COUNTY STAFF PRESENT: Interim County Manager Rod Visser and Clerk to the <br />Board Donna S. Baker (All other staff members will be identified appropriately below) <br />NOTE: ALL DOCUMENTS REFERRED TO IN THESE MINUTES ARE IN THE <br />PERMANENT AGENDA FILE IN THE CLERK'S OFFICE. <br />A motion was made by Commissioner Halkiotis, seconded by Commissioner Carey to go <br />into closed session at 10:35 p.m. for the purpose: <br />"To discuss the County's position and to instruct the County Manager and the County <br />Attorney on the negotiating pasition regarding the terms of a contract to purchase real <br />property for a county offices," NCGS 143-318.11 (a) (5} <br />VOTE: UNANIMOUS <br />OTHER STAFF PRESENT: Pam Jones <br />GATEWAY BUILDING <br />Geof Gledhill said it is being proposed that the County enter into a fixed price <br />construction manager at risk {CMR) contract with a Horton "entity" for the construction of <br />the Gateway building. This building will be candominiumized and the County will lease- <br />purchase a condominium that includes the top two floors of the Gateway Building plus <br />an in common interest in the common area associated with the Gateway Building. This <br />lease will be far one year plus one day from the date the building is occupied by the <br />County and will include 22, 846 square feet of office space. The lease price will be <br />$565,500 far the lease term. Geof Gledhill said that it is anticipated that this building will <br />be ready for occupancy on or about November 2007. The County will purchase the <br />property leased at the end of the lease term. The purchase price will be approximately <br />$5,500,000. <br />Geof Gledhill reviewed same of the pros of leasing the building far one year in that it will <br />solve several of the problems that had been associated with the overall County complex <br />purchase, including the County avoiding the complexities of being a party to an <br />agreement with Weaver Street Market. The lease will also require the Horton entity, as <br />the owner of the Gateway Building, to be responsible for any and all warranty issues <br />
