D E S -,20 0 <br /> RESOLUTION <br /> OF THE <br /> ORANGE COUNTY BOARD OF COMMISSIONERS <br /> Whereas,the Orange County Board of Commissioners is charged with protecting the <br /> health, safety, and welfare of all Orange County residents; and <br /> Whereas,the Orange County Board of Commissioners desires to preserve currently <br /> available affordable housing options for residents of Orange County; and <br /> Whereas,failing septic systems that discharge sewage to the ground constitute a <br /> significant public health risk for residents living in these conditions; and <br /> Whereas,failing septic systems may lead to groundwater contamination; and <br /> Whereas,the mobile home spaces in the L&W Mobile Home Park constitute forty-one <br /> affordable housing spaces; and <br /> Whereas,the Environmental Health Division of the Orange County Health Department <br /> has determined that the septic systems of the L&W Mobile Home Park are not <br /> repairable using conventional waste water technologies; and <br /> Whereas,residents in fourteen of the forty-one mobile homes in the L&W Mobile <br /> Home Park are living with failing septic systems; and <br /> Whereas,the owner of the L&W Mobile Home Park desires to remedy this public <br /> health concern for the residents of the L&W Mobile Home Park be seeking connection <br /> to the Durham sewer system; and <br /> Whereas,the owner of the L&W Mobile Home Park has expressed willingness to fully <br /> fund the construction of the required force main and pump station; and <br /> Whereas,the Orange County Board of Commissioners recognize that connecting the <br /> L& W Mobile Home Park to the sewer system of the City of Durham has potential <br /> comprehensive planning implications and in adopting this resolution anticipates a <br /> dialogue with the City of Durham with a desired outcome of an interlocal agreement <br /> between Orange County and the City of Durham related to land use regulations,public <br /> water and sewer services and annexation boundaries; <br /> Therefore Be It Resolved that the Orange County Board of Commissioners does hereby <br /> agree that the City of Durham may acquire interests in land necessary for the extension of <br /> Durham City Sewer Facilities for service to L&W Mobile Home Park, located in the <br /> eastern portion of Eno Township,Orange County and identified as Orange County Tax <br /> Parcel 5.25..91. <br /> This,the 19th day of June, 2001. <br />
