2 <br /> Attachment 1 includes a table outlining the various comments/concerns identified as part of the initial <br /> review of the project as well as those made during the August 27, 2012 public hearing. Materials for <br /> the public hearing are available on-line at http://orangecountync.gov/OCCLERKS/120827c2.pdf. <br /> The table provides the applicant's suggestions on addressing these various concerns. <br /> Attachment 2 contains the applicant's written responses to the questions and comments from the <br /> public hearing. The applicant has provided a copy of the revised site plan for review in an 11" x 17" <br /> format. Attachment 3 contains additional documentation from various County staff members <br /> reviewing the project. <br /> Conditional Zoning (CZ) Process: As articulated during the hearing, the CZ process involves <br /> the approval of a rezoning petition and a site plan to allow for the development of a specific land <br /> use on a parcel of property. Decisions on the viability of the proposal are based on the BOCC's <br /> determination that the project is consistent with the intent of the Comprehensive Plan. <br /> The normal cadence of review is as follows: <br /> • CZ applications are reviewed during one of the four joint Quarterly Public Hearings held <br /> by the Planning Board and the BOCC; <br /> • The applicant is required to demonstrate that the project is consistent with the provisions <br /> of the adopted Comprehensive Plan, is appropriate for the area in which it is located, and <br /> embodies the overall spirit and intent of the various provisions of the Unified <br /> Development Ordinance (UDO); <br /> • The item will be forwarded to the Planning Board for a recommendation; <br /> • The BOCC will receive the Planning Board recommendation and make a final <br /> determination on the merits of the request. <br /> Per Section 2.9.2 (F) (3) of the UDO, conditions can be imposed as part this process <br /> only if they address: <br /> 1. The compatibility of the proposed development with surrounding property, <br /> 2. Proposed support facilities (i.e. roadways and access points, parking, <br /> pedestrian and vehicular circulation systems, screening and buffer areas, <br /> etc.) and/or <br /> 3. All other matters the County may find appropriate or the petitioner may <br /> propose. <br /> It should be noted all conditions must be agreed upon by the County and the applicant. <br /> The applicant must agree in writing to the imposition of all conditions. <br /> • If approved, the Zoning Atlas is amended and the zoning designation of the property shall <br /> become REDA-CZ-1. <br /> • The applicant shall be required to submit a final site plan in accordance within Section 2.5 <br /> of the UDO. This ensures that staff can verify all imposed conditions are adhered to and <br /> allows for final peer review by members of the Development Advisory Committee (DAC) <br /> as detailed within Section 1.9 of the UDO. There is, however, no additional site plan <br /> review fee assessed to the applicant. <br />
