61 <br /> • <br /> NC STANDARD PPA.DOC(Revised November 1,2010) NCUC Docket No.E-100,Sub.127 <br /> 1 PURCHASED POWER AGREEMENT <br /> 2 <br /> 3 THIS PURCHASED POWER AGREEMENT("Agreement")is made <br /> 4 this di day of ,20 ,by and between <br /> 5 <br /> - 6 <br /> 7 DUKE ENERGY CAROLINAS,LLC, <br /> 8 <br /> 9 <br /> 10. a North Carolina Limited Liability Company("Company"),and <br /> 11 <br /> 12 <br /> 13 SUPPLIER NAME, <br /> 14 <br /> 15 ("Supplier"or"Customer"),for the <br /> 16 <br /> 17 "Facility Name," <br /> 18 <br /> 19 which is or will be a qualifying facility as defined by the Federal Energy Regulatory Commission <br /> 20 ("FERC")pursuant to Section 210 of the Public Utility Regulatory Policies Act of 1978, consisting <br /> 21 of , (the "Facility"), located at <br /> 22 <br /> 23 <br /> 24 (Hereinafter,the parties are also referred to individually as"Party"and collectively as"Parties"). <br /> 25 <br /> 26 In consideration of the mutual covenants herein contained, the Parties hereto, for themselves, their <br /> 27 successors and assigns,do hereby agree to the following: <br /> 28 <br /> 29 1. Service Requirements. <br /> 30 <br /> 31 1.1 The Supplier shall sell and deliver exclusively to the Company all of the electric power <br /> 32 generated by the Facility, net of the Facility's own auxiliary electrical requirements, and the <br /> 33 Company shall purchase,receive,use and pay for the same,subject to the conditions contained <br /> 34 in this Agreement. If the Supplier will receive back-up and maintenance power for the <br /> 35 Facility's auxiliary electrical requirements from the Company,such power shall be provided to <br /> 36 Supplier pursuant to a separate electric service agreement under the Company's rate schedule <br /> 37 appropriate for such service. <br /> 38 <br /> 39 1.2 The electric power to be delivered hereunder shall be phase,alternating,at a frequency <br /> 40 of approximately sixty(60)hertz,and at approximately volts. <br /> 41 <br /> 42 1.3 Delivery of said power shall be made in County at or near <br /> 43 , North Carolina at a delivery point described as follows: <br /> 44 <br /> 45 <br /> 46 <br /> • Page 1 of 12 <br />
