Ratio Explanations <br /> PURPOSE: To make a recommendation to the BOCC on a general use rezoning petition and <br /> Class A Special Use Permit (hereafter `SUP') modification submitted by Mr. Spence Dickinson in <br /> accordance with the provisions of the Unified Development Ordinance (hereafter `UDO'). <br /> BACKGROUND: This item was presented at the May 29, 2012 Quarterly Public Hearing where <br /> staff indicated the purpose of the request was to rezone a 4.003 acre parcel of property (PIN <br /> 9871-54-9182): <br /> From: Rural Buffer(RB) and Planned Development Housing Rural Residential (PD-H-R1) <br /> To: Rural Buffer(RB) <br /> and remove the property from the provisions of a previously recorded SUP. The property in <br /> question is north of intersection of Blackwood Mountain Road (SR 2258) and Pathway Court, a <br /> private road maintained by the local homeowners association (please refer to Attachment 1). <br /> During the hearing, Mr. Dickinson indicated he was requesting the rezoning and SUP <br /> modification to remove the subject parcel from the development and zoning restrictions of the <br /> Heartwood SUP in an effort to address existing septic issues on an adjacent parcel of property. <br /> Public Hearing: During the hearing, the following comments/questions were posed concerning the <br /> application: <br /> • An adjacent property owner, Mr. Charles Lamb, indicated he had no problem with the <br /> request but wanted assurances that once the subject parcel was recombined with the <br /> adjacent property (i.e. the camp) there would be no vehicular access from that property <br /> onto Pathway Court and that the property would remain in a vegetated, undeveloped, <br /> state. <br /> STAFF COMMENT: Vehicular access would not be allowed as Pathway Court is <br /> a private road subject to the provisions of the Heartwood SUP. Only property <br /> encumbered by the Heartwood SUP can access the roadway. <br />
