Also as this lot is now being removed from the confines of the Heartwood Special Use <br /> Permit there is no longer any legal right of access to Pathway Court from the property. <br /> Motion made by Lisa Stuckey to approve Sections 2.2 and Section 2.7.3 and accept staffs recommendation. <br /> Seconded by Maxecine Mitchell. <br /> Vote: Unanimous <br /> Motion made by Tony Blake to accept staffs recommendation for Section 2.7.5 Class A Special Notification <br /> Requirement. Seconded by Maxecine Mitchell. <br /> Vote: Unanimous <br /> Motion made by Alan Campbell to approve Sections 5.3.2(A)(2)(a) that the use will maintain or promote the public <br /> health, safety and general welfare, if located where proposed and developed and operated according to the plan as <br /> submitted based on correspondence from staff that there are no problems along these lines and evidence presented <br /> at other hearings and also entered into the record from the applicant as summarized earlier in our hearing by Mr. <br /> Harvey. Seconded by Tony Blake. <br /> Vote: Unanimous <br /> Motion made by Alan Campbell to approve Section 5.3.2(A)(2)(b) that the use of the project will maintain and <br /> enhance the value of the contiguous property which is based on the applicant's testimony at the public hearing and <br /> materials submitted in the record. Seconded Buddy Hartley. <br /> Vote: Unanimous <br /> Motion made by Alan Campbell to approve Section 5.3.2(A)(2)(c) that for this project, the location and character of <br /> the use, if developed according to the plan submitted,will be in harmony with the area in which it is to be located and <br /> the use is in compliance with the plan for the physical development of the County as embodied in these regulations <br /> or in the Comprehensive Plan, or portion thereof, adopted by the BOCC all pursuant to the testimony presented by <br /> the applicant at the hearing or otherwise submitted.
