24 <br /> RECOMMENDATION: <br /> Staff has not received any information that would establish grounds for making a negative finding on the general <br /> standards. These standards include maintaining or promoting the public health, safety, and general welfare, <br /> maintaining or enhancing the value of contiguous property, and the use being in compliance with the general plan <br /> for the physical development of the County. <br /> Staff has reviewed the application, the site plan, and all supporting documentation and has found that the <br /> applicant complies with the specific standards and required regulations as outlined within the UDO. <br /> Provided the Planning Board and the Board of County Commissioners finds in the affirmative on the specific and <br /> general standards, the Board could make a positive finding on this application. In the event that the Board of <br /> County Commissioners makes the determination that the permit can be issued, Planning Staff recommends the <br /> attachment of the following conditions to the Special Use Permit: <br /> 1. That an Ordinance approving the rezoning of the subject parcels as requested by the applicant as <br /> part of the application submittal process be approved by the Board of County Commissioners; <br /> 2. Condition 17 of the Original Special Use Permit, approved on September 2, 1986 and recorded <br /> within the Registrar of Deeds office within Book 725 at Page 306, required that the developer <br /> produce: `a final boundary survey of the Planned Development (i.e. Heartwood)'. As part of this <br /> revision the applicant shall, within 180 days from the approval of this modification, cause the <br /> production of a revised boundary survey for the Heartwood and Blackwood Mountain Planned <br /> Development denoting the new boundary line and submit it to the Orange County Planning <br /> Department for approval.
