Both the County Attorney's office and Planning will still organize the <br /> legal aspects of easement dedication. Orange County staff has held community outreach <br /> meetings describing the project and the necessity of easements. However, because HUA has <br /> experience performing this type of work on previous projects, and staff experience with <br /> acquiring easements is limited, staff believes the process would go more smoothly if HUA were <br /> contracted to coordinate the easement acquisition process. This easement process will be <br /> concurrent with the permitting for the project and will take place over the next two months. <br /> Buckhorn-Mebane EDD Phase 2 - Extension (Efland sewer redirection to Mebane) <br /> The second amendment to the HUA contract entails the design phase of the Efland sewer flow <br /> to Mebane redirection. This project went through `feasibility engineering' as part of HUA <br /> Buckhorn-Mebane Phase 2 project since this new flow from Efland will flow through the new <br /> sewer master planned area completed by HUA with the original contract. Agreements are now <br /> in place with the City of Mebane to permit these new Efland flows. <br /> This project was anticipated in the adopted Fiscal Year 2012-13 Capital Investment Plan (CIP) <br /> and after completion will eliminate the approximately $100,000 annual subsidy to support the <br /> Efland sewer system users. Orange County has aligned its sewer rates in Efland to compare <br /> with the City of Mebane `outside city rate' which has been a dramatic moderation in rate <br /> increases originally expected in the Efland area. <br /> Also, as a side engineering note, minor field piping changes were made in the ongoing Efland <br /> sewer project (also known as Efland Sewer Expansion Phase 1 East and Phase 2) to create <br /> cost and operational efficiencies when the sewer flow redirection projects begins. <br /> FINANCIAL IMPACT: This first amendment will add: <br /> 1.1 Easement Negotiations HUA $30,500 <br /> The cost of any easement appraisals will be negotiated on a case-by-case basis due to the <br /> wide variation in potential cost and would be considered a reimbursable item in addition the <br /> amount above. Staff recommends an additional easement appraisal allocation of <br /> 1.2 Easement, Appraisal and Dedication Fund (Budget) <br /> $29,000 should be set aside as a budget amount for this reimbursable item. Money has <br /> been set aside in the recommended capital budget for this project which will cover the cost <br /> of purchasing the easements and any permitting fees for the project. <br /> 1.3 Buckhorn Mebane EDD Phase 2 Bid Management Services <br /> 2. Buckhorn-Mebane EDD Phase 2 - Extension (Efland sewer redirection to Mebane) Design <br /> Services <br /> The second amendment (i.e. Buckhorn Mebane Phase 2 Extension or Efland Sewer Flow <br /> Redirection Engineering Design) is funded in Fiscal Year 2012-13 in the amount of <br /> $160,000. This proposal is $151,600 and within budget. <br /> RECOMMENDATION(S): The Manager recommends the Board: <br /> 1. Approve the contract amendments; <br /> 2. Authorize the Chair to sign on behalf of Orange County; and <br /> 3. Authorize the Manager to sign permit applications or other documents related to the <br /> permitting with bid results for Buckhorn Mebane EDD Water and Sewer Project- <br /> Phase 2 to be brought to the BOCC for approval in the Fall 2012. <br />
