• <br /> MC 11 <br /> A S S O C I A T E S <br /> June 20,2012 <br /> Mr. Christopher Stike <br /> Project Manager <br /> JF Wilkerson Contracting Co.,Inc. <br /> Post Office Box 183 <br /> Morrisville,North Carolina 27560 <br /> RE: Response to Ruritan Club Septic Tank Delay <br /> Buckhorn/Efland Sewers <br /> Orange County,North Carolina <br /> Dear Mr. Stike: <br /> McGill Associates is in receipt of your letter dated May 15, 2012 requesting compensation <br /> due to the delay caused by the discovery of the Ruritan Club septic tank that was in direct conflict <br /> with the sewer line installation. Article 12 of the General Conditions of the Contract Documents <br /> allows the Contractor the right to make the claim as you have in your letter. We agree that JF <br /> Wilkerson encountered such a delay and is due a time extension and compensation. However, we do <br /> not agree with the dollar amount requested. <br /> This determination arises from the fact that for two (2) days JF Wilkerson's crew was not <br /> able to perform any work and one(1)day was required to demolish the septic tank. For those two(2) <br /> days where the crew and equipment was idle, no fuel would have been used by the equipment. We <br /> recognize that fuel would have been used to crush the tank on the third day end for the vehicles to <br /> transport the crew to the project all three(3)days. <br /> Therefore, after removing the fuel cost for the equipment for two (2) clays and recalculating <br /> the costs per the supporting documentation, we can recommend to the Owner a change in Contract <br /> Times of three(3)days and a change in Contract Amount of$9,732.22. We respectfully request that <br /> JF Wilkerson formally respond to this letter with your acceptance so that a Change Order can be <br /> processed. <br /> We appreciate JF Wilkerson's continued efforts in the construction of the Buckhorn-Efland <br /> Sewers project and look forward to the completion of a successful project.
