ARTICLE III <br /> ARCHITECTURAL CONTROL <br /> p. Architectural Control fnr Lots I -24. <br /> 1. Until such time as Declarant shall no longer be a Class B Member of the Association,no <br /> dweiling or other structure ar other impravements(the"Improvements")shali be erected, <br /> placed or altered on any of Lots 1 -24 in the Praperties, or in any additit�n theretfl,until <br /> the Improvement's ptans and specifications far such Lot and the Lot ptan fpr such Lc�t <br /> {showing the locatian of such Improvements on the Lot) and the Landscaping Plan for <br /> such Lot(caliectiveIy,the"Plans"}have been approved in writing by the Declarant as ta <br /> conformity witfi the Restrictions,quality,materials and as to conformity and harmony of <br /> external design with existin�{and approved or proposed}Improvements in the Properties, <br /> and as to location of the irripravements with respect ta topography and finished ground <br /> etevation. Such written approval from the L}eclarant must be obtained prior to <br /> commencing clearing, grading or construction of any kind nn a Lot. All Improvements <br /> shail compiy with the plans as presented unless changes are appraveci in writing by the <br /> Declarant. The written approval of Declarant shall also be required prior to erecting, <br /> placing or altering mail boxes,signs and newspaper boxes upon any lat. Cont�act Seller or a Builder ta be built within the Subdivision, and, upon Declarant's <br /> written approval of such typical Plans, Specifications, and Materials, residences may be <br /> constructed in the Subdivision cansistent with such approved Plans, Specifications, and <br /> Materiais without the requirement of further review by the Declarant. Only Builders <br /> approved by Declarant shatl be used to conshvct homes in the development. Deciarant <br /> reserves the right to require that the Bui�der of each residence in the Subdivision is a <br /> member of the then current approved Builder Team for the Deveiopment. <br /> 2, Upon or pri4r xo the date upon whi�h Declarant shall cease_to be a Class B Member of the _ _. <br /> . _ _ --- - <br /> Association, the Declarant shall form an "Architecturai Review Committee" for the <br /> Properties (tcerein referred ta as the "Cammittee"}, which said Committee shall tse <br /> comgosed of three {3} members appointed by the Declarant. The initial three {3) <br /> members of the Committee shall serve until the annuai meeting of the Associatian next <br /> immediately fallowing the date of such appointment by the Declarant. Thereafter tha <br /> members of the Cammittee shaii be appainted by the Board of Directors of the <br /> Assaciation, each such member ta serve for a tertn of one (l}year, said term to expire <br /> upon the date af the annual meeting of the Association. Each member of the Committee <br /> shal! have one {l} vote and a majority vote of the Committee shall be required ta <br /> � constitute Committee action on any issue brought before the Committee. So long 2s <br /> Declarant is a Class B Member, ai( Improvements and placement of Improvements by <br /> Buitders andlor Contract Seliers shall require the approvai of the Declarant. All <br /> impr�vements and placement of Improvements by Lot�wners subsequent to the transfer <br /> of ownership of a house from a Bnilder/and or Contract Seller will require the appraval <br /> • of the Architectural Committee. So long as Declarant is a Class B Member, Declarant <br /> reserves the right to approve nr reject any guidelines andfor approvals of the Comrnittee. <br /> tJpan the date upon which Declarant shal( no tonger be a Class B Member of the <br /> Association,the Committee sha11 assume and be responsibie for atl of the approvals and <br /> responsibitities sec fonh in subparagraph 1 of paragraph A af this Article with regard to <br /> Architeckural Cantrol within the Properties, provided, however, that the Declarant shall <br /> retain tha exclusive right to approve all initial dwelling,and lot improvements including, <br /> but nat limited to, house location, landscape plan and initiaF exterior colors and materials . <br /> 5 <br />
