APPROVED 1/24/2006 <br />MINUTES <br />ORANGE COUNTY BOARD OF COMMISSIONERS <br />REGULAR MEETING <br />November 15, 2005 <br />7:30 p.m. <br />The Orange County Board of Commissioners met in regular session on Tuesday, November 15, <br />2005 at 7:30 p.m. at the Southern Human Services Center, in Chapel Hill, North Carolina. <br />COUNTY COMMISSIONERS PRESENT: Chair Moses Carey, and Commissioners <br />Valerie P. Foushee, Alice M. Gordon, Stephen Halkiotis, and Barry Jacobs <br />COUNTY COMMISSIONERS ABSENT: <br />COUNTY ATTORNEYS PRESENT: Geoffrey Gledhill <br />COUNTY STAFF PRESENT: County Manager John M. Link, Jr., Assistant County <br />Managers Rod Visser and Gwen Harvey and Clerk to the Board Donna S. Additions or Changes to the Agenda <br />Chair Carey asked the Board to consider one change. Item 9-e is time sensitive and he <br />asked that it be moved up to item 9-a-2. The Board agreed. <br />PUBLIC CHARGE <br />The Chair dispensed with the reading of fhe public charge. <br />2. Public Comments <br />a. Matters not on the Printed Agenda <br />James Johnson is a commercial developer from High Point, North Carolina. He said that <br />he wrote a contract on a property adjacent to the Orange County Speedway in September. <br />Before he wrote the contract, he spoke with the Planning staff about the possibilities involved in <br />this and he was given a head's up that this area was residential in nature and he was given four <br />options. He said that Mr. Agee has opened the Orange County Speedway and they are buying <br />the property next door, which is 80+ acres and they would like to open the go-cart track and air <br />motocross track, which would be in keeping with what was already there. He said that it just <br />makes sense and the property is not residential in nature. He was told that the land use plan <br />was on the way, but he thinks this will take too long. He wants to modify the land use plan that <br />is already in effect so that they can do this non-conforming use and a rezoning. He has <br />contacted about 15-20 landowners in the area, and they are in agreement. He asked the <br />County Commissioners to modify the existing land use plan and get a rezoning that would allow <br />this activity to take place. He has seen this done in other nearby counties. He wrote this <br />contract in September, but he started working with Orange County in June. He has a 90-day <br />due diligence, which expires on December Stn <br />Chair Carey said that, if he understands what he wants them to da, it would still take <br />longer than when the due diligence expires. He said that the County Commissioners would take <br />this under advisement. <br />
