Geaff Gledhill added that the county has governmental immunity and it is not a <br />liability with responsibility issue. The county's insurance policy kicks in if there is <br />negligence on the part of the caunty employees performing their functions. He said that <br />from what he is hearing, the experts are saying this method of doing it is responsive. <br />Commissioner Foushee said that it appears the liability would be greater if the <br />park is supervised. <br />Geaff Gledhill said that skate boarding is not the same thing as swimming; there <br />is a risk that is inherent with the sport. <br />Commissioner Gordon wanted to follow up on the governmental immunity issue. <br />She said that a private citizen could wander onto the property which has an attractive <br />nuisance and she understood that the County Attorney was saying that this does not <br />apply because of governmental immunity. <br />Geaff Gledhill said that is true sa long as the activity the caunty is doing is a <br />governmental function and recreation is a governmental function. <br />Commissioner Gordon followed up on the questions on the parking space. She <br />understands that the 27-space area and the 62-space area are what are needed for the <br />ordinance. Marabeth Carr said they would be providing a total of 96 new spaces. <br />Planning would like for them to provide 163. <br />Commissioner Gordon said that she wanted to follow-up on what Commissioner <br />Jacobs had said about parking in the existing gravel area and if the reason they can't do <br />the 5Q- space area is just because of zoning problems. She also wanted to fallow-up an <br />the walking track because she felt they were making an argument for putting one near <br />the ball field and wondered whether this other track would be a measured trail. <br />Marabeth Carr said they could make this track a measured trail. <br />Commissioner Gordon said that going down the citizen priority list there were a <br />number of questions. She noted that they did not put the large picnic shelter or restroom <br />storage high on their list. The ball field, skate area, basketball courts and multi-purpose <br />field should probably be considered. The other things leave a number of questions. She <br />really does not knave whether or not to build the skate park. Some of the other items <br />appear to be questions that need to be resolved in the future. <br />Dave Stancil said that the group did not actually recommend any facilities so <br />there aren't any shown and unless the Board wants to add some sort of tier there is <br />really no action necessary. <br />Commissioner Halkiotis said that he would never vote to build a skate park that <br />was going to be unsupervised. He also feels this would generate an editorial that would <br />not be very flattering. He thinks that they have been extremely generous in their <br />analysis of this and he feels that they need to study the issue a lot mare. The whole <br />skateboarding issue really was an early issue coming out of Hillsborough because they <br />were driving everybody in downtown Hillsborough crazy. Police were chasing them out <br />of the parking lots. These kids are not going to walk all the way out to Cedar Grove to <br />skate board unless their parents take them because they can't drive. He feels that an <br />unsupervised center is just giving somebody a license to maim themselves. <br />Commissioner Jacobs agreed with Commissioner Halkiatis about the skate park <br />especially if they are over budget. He feels it is the most problematic aspect of the park <br />and he can easily see something in the future work and give staff the opportunity to think <br />it through. He agrees with Commissioner Halkiotis about the likelihood of someone <br />getting hurt and the likelihood that it will be used a lot in a rural setting. Maybe they <br />could talk about at the Fairview Park where it may be more likely to be used. He said <br />that then they would be pretty close to the budget that staff has developed. He would <br />like to see something that indicates a future visual amenity waterway even if it is just off <br />the trail. He thinks it would be an enjoyable part of the trail to overlook a waterway. <br />
