1) Oppose House Bill 671 -Plant Regulation, a copy of the current version of which is <br />attached as Exhibit A, and any successor versions or other similar bills (i.e. <br />Companion Senate Bill 631}, which seek to prevent towns, cities, and counties from <br />adopting any regulations ar ordinances concerning any kind of plant. This bill <br />constitutes an effort to preempt local authority by removing the ability of local <br />governments to assess the potential impacts of plants, including the introduction of <br />genetically modified crops, on organic farming, other agricultural and plant-growing <br />activities, and public health concerns, and gives sole authority to the North Carolina <br />Department of Agriculture for the regulation of plants. {Information regarding this bill <br />which was previously provided to the Board of Commissioners by the Carolina Farm <br />Stewardship Association is provided as Exhibit B}. <br />VOTE: UNANIMOUS <br />c. Senate Bill 951 -Public-Private Solid Waste Collection <br />Commissioner Jacobs said that Senate Bill 951 has several effects, such as if a <br />government wants to take over a solid waste operation, it would have to compensate the private <br />hauler that it might displace. <br />Geof Gledhill said that the compensation to be paid to the vendor is the gross revenue of <br />the collection. Senator David Hoyle sponsored this bill. <br />Commissioner Jacobs said that Solid Waste Director Gayle Wilson has put together a <br />draft resolution. Gayle Wilson said that he has been working against this bill for several <br />months, and he urged the Board to adopt it and forward it to the delegation. <br />A motion was made by Commissioner Jacobs, seconded by Commissioner Halkiotis to <br />approve the resolution as stated below opposing Senate Bill 951. <br />Geof Gledhill said to add to the resolution requesting the Governor to veto this bill in the <br />event that it passes the General Assembly. <br />Resolution Opposing <br />NC Senate Bill 951 -Public-Private Solid Waste Collection <br />WHEREAS, County and municipal governments have been granted by the NC General Statutes <br />the authority to enter into service contracts with the private sector; and, <br />WHEREAS, County and municipal governments are responsible for delivery of basic services to <br />their citizens; and, <br />
