The Board considered a modification in the 2005 rate order resolution adopted an May <br />3~d to provide additional time for Time Warner Cable to respond on the contested issue of Form <br />1235 filing. <br />Assistant County Manager Gwen Harvey said that she made a miscalculation on the rate <br />order and the extension should be far an additional 90 days to make it a total of 120 days. <br />Commissioner Gordon asked why additional days were needed. Gwen Harvey said that <br />this is at the request of Time Warner Cable and at na additional cost to the County. Time <br />Warner needed additional time to gather information and respond to the requests from the <br />Board of County Commissioners. <br />Commissioner Jacobs asked how they know, based on Time Warner's history that they <br />are not trying to delay for 120 days so that they can lobby the FCC to prevent the County from <br />taking the information. Gwen Harvey said that there is no way to know this. She accepted this <br />on good faith and she consulted with Triangle J Cable Consultant Bab Sepe, and he did not see <br />any problems. <br />Commissioner Jacobs said that the Board authorized Gwen Harvey through the month <br />of June to negotiate with Time Warner. He asked how these negotiations were going. Gwen <br />Harvey said that the Board's direction to staff was to bring back results of these negotiations no <br />later than September. The next meeting is June 29th. She said that there is agreement about <br />density, capital costs, and the ability to live cast the Board of County Commissioners' meetings. <br />She believes that they have kept on task and that they are very near resolution. <br />Chair Carey commended Gwen Harvey an the update she provided and encouraged the <br />Board to act favorably on this. <br />Commissioner Halkiotis said that he is amazed at Gwen Harvey`s resilience on this. He <br />said that he is totally against this, and he is tired of it. He has lost faith in Time Warner. He <br />appreciates the work that Gwen Harvey has done, even after Time Warner treated her in a very <br />insulting manner. <br />A motion was made by Commissioner Jacobs, seconded by Commissioner Faushee to <br />approve the extension of time allowable for Time Warner Cable to respond to the requirements <br />in the May 3, 2005 rate order resolution regarding the 1235 rate filing from 30 days to a total of <br />100 days (September 15th}. <br />VOTE: Ayes, 4; Nay, 1 (Commissioner Halkiotis} <br />IL Budget Amendment #13 <br />The Board considered approving budget ordinance and capital project ordinance <br />amendments for fiscal year 2004-05. <br />Commissioner Gordon asked Budget Director Donna Dean about this and if this was on <br />the debt issuance schedule. Donna Dean said that this is something they have done for several <br />years. When the Public School Building Funds were first adopted, it could not be used for debt <br />service, and now it can. It offsets the debt service. <br />Commissioner Gordon clarified that this does not affect the new funding policy. <br />A motion was made by Commissioner Jacobs, seconded by Commissioner Gordon to <br />approve and authorize the Chair to sign the application for Public School Building Capital Funds <br />for the Orange County Schools' share of the remaining 2004-05 debt service payment related to <br />construction of Stanback Middle School. <br />VOTE: UNANIMOUS <br />6. Economic Development Strategic Plan <br />The Board considered formally endorsing Investing in Innovation, the Orange County <br />Economic Development Commission Five-Year Strategic Plan. <br />
