ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: June 5, 2012 <br />Action Agenda <br />Item No. 5— j< <br />SUBJECT: Request for Road Addition to the State Maintained Secondary Road System <br />DEPARTMENT: Planning and Inspections PUBLIC HEARING: (Y /N) EN <br />ATTACHMENT(S): INFORMATION CONTACT: <br />1 a — Map of Birdsong Lane Darcy Zorio, 245 -2582 <br />1 b — Birdsong Lane NCDOT Documentation Tom Altieri, 245 -2575 <br />Craig Benedict, 245 -2585 <br />PURPOSE: To make a recommendation to the North Carolina Department of <br />Transportation ( NCDOT) concerning a petition to add a subdivision road in Birdsong <br />Subdivision (Birdsong Lane) to the State Maintained Secondary Road System. <br />BACKGROUND: This request includes one (1) petition for road additions to the State <br />Maintained Secondary Road System. The road is: <br />Birdsong Subdivision (Birdsong Lane) —Attachment la <br />The requested road addition is about 0.36 miles long. Ten houses have entrances to the <br />road submitted for addition. Birdsong Lane is located 3.5 miles east of the intersection of <br />NC 86 North and Sawmill Road. <br />Birdsong Subdivision was approved by the Board of Commissioners on December 11, <br />2001. NCDOT has investigated these requests and has submitted petitions to the BOCC <br />for its recommendation (Attachment 1 b). <br />Conclusion <br />The above - referenced application meets the criteria endorsed by the BOCC for <br />recommending acceptance of a public road into the State Maintained System for roads <br />approved through the governing jurisdiction's major subdivision process. <br />In accordance with North Carolina General Statute §136 -62 *, the Board is required to make <br />a recommendation regarding the petitions to the North Carolina Board of Transportation <br />( NCBOT) before NCDOT can consider the petitions. <br />` North Carolina General Statute §136 -62 directs that "The citizens of the State shall have the right to <br />present petitions to the board of county commissioners, and through the board to the Department of <br />Transportation, concerning additions to the system and improvement of roads. The board of county <br />commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their <br />recommendations." <br />
