Resolution Approving Application for a Clean Water State Revolving Fund Loan to <br /> 15 Finance the Proposed McGowan Outfall <br /> 16 The Board approved a resolution authorizing staff to apply for a North Carolina Department <br /> 17 of Environment and Natural Resources Clean Water Revolving Fund Loan funding to <br /> 18 finance the elimination of an existing pump station and construction of a proposed sewer <br /> 19 collections outfall line and authorized the Chair to sign. <br /> 20 <br /> 21 RESOLUTION BY ORANGE COUNTY BOARD OF COMMISSIONERS <br /> 22 WHEREAS, The Federal Clean Water Act Amendments of 1987 and the North Carolina <br /> 23 Water Infrastructure Act of 2005 (NCGS 159G) have authorized the making of <br /> 24 loans and grants to aid eligible units of government in financing the cost of <br /> 25 construction of wastewater collection system infrastructure, and <br /> 26 WHEREAS, The Orange County Board of Commissioners has need for and intends to <br /> 27 construct a wastewater collection system infrastructure project described as the <br /> 28 McGowan Outfall and <br /> 29 WHEREAS, The Orange County Board of Commissioners intends to request state loan <br /> 30 assistance for the project, <br /> 31 NOW THEREFORE BE IT RESOLVED, BY THE ORANGE COUNTY BOARD OF <br /> 32 COMMISSIONERS: <br /> 33 That Orange County Board of Commissioners, the Applicant, will arrange <br /> 34 financing for all remaining costs of the project, if approved for a State loan <br /> 35 award. <br /> 36 That the Applicant will adopt and place into effect on or before completion of the <br /> 37 project a schedule of fees and charges and other available funds which will <br /> 38 provide adequate funds for proper operation, maintenance, and administration of <br /> 39 the system and the repayment of all principal and interest on the debt. <br /> 40 That the governing body of the Applicant agrees to include in the loan <br /> 41 agreement a provision authorizing the State Treasurer, upon failure of the <br /> 42 County to make scheduled repayment of the loan, to withhold from the County <br /> 43 any State funds that would otherwise be distributed to the local government unit <br /> 44 in an amount sufficient to pay all sums then due and payable to the State as a <br /> 45 repayment of the loan. <br />
