Harvey, Planner III 245 -2597 <br />Craig Benedict, Director 245 -2575 <br />PURPOSE: To hold a public hearing and receive comment on a general use rezoning petition and <br />Class A Special Use Permit modification in accordance with the provisions of the Unified <br />Development Ordinance (hereafter 'U DO'). <br />BACKGROUND: On December 5, 2011 staff received an application proposing the rezoning of a <br />parcel of property off of Pathway Court: <br />From: Rural Buffer (RB) and Planned Development Housing Rural Residential (PD -H -R1) <br />To: Rural Buffer (RB) <br />The subject parcel is partially located within Heartwood at Blackwood Mountain, a 35.21 acre <br />(1,533,747 sq.ft.) Planned Development approved by the County in 1986. The project called for <br />the development of 35 single - family residences along with common area and recreation <br />amenities. The Special Use Permit (hereafter `SUP') governing the development of the project <br />is recorded within Deed Book 725 Page 306 of the Registrar of Deeds (Please refer to <br />Attachment 1 for a copy of the permit). <br />The basic facts of the application are as follows: <br />Applicant: Spence Dickinson <br />6407 Millhouse Road <br />Chapel Hill, NC 27516 <br />Agent(s): Jim Holland — Holland Surveying <br />Location: North of intersection of Blackwood Mountain Road (SR 2258) and <br />Pathway Court, a private road maintained by the local homeowners <br />association <br />
