it was on the table to downsize the vicinity of the church to R-LD-S. This would have been a <br />minimum five-acre lot size. There was limited participation from the historic low-income <br />community around the church. They came before the Council and said that they had owned this <br />land and wanted to pass it down to their children and they asked the council to accommodate <br />them and not make it impassible to further subdivide their land. At that point, the Town Council <br />zoned it R-LD-1 so that they could further subdivide their land. He said that if this area is <br />included in this proposal, he would like to adjust the lines to accommodate this community. <br />Craig Benedict said that the White Rock Holiness Church is one of the properties in the area <br />(pp. 34-35). <br />Roger Waldan said that he remembers those discussions with the people in this area. He said <br />that some of those properties are now zoned R-LD-1, and there is no water and sewer service <br />available. The lot size is generally determined by this factor. For those properties, this action <br />would change the zoning from a one-acre minimum to a larger minimum lot size. <br />Commissioner Brawn asked far clarification of the proposed area and Craig Benedict explained <br />this and showed it an the map. <br />Alex Zaffron said that the part that they are talking about is the Southern Transition Area, which <br />is the only area in which there is joint jurisdiction. He said that Mark Chilton's point was <br />rendered moot by the decision that was made to remove the Southern Transition Area from the <br />urban services area, and therefore water and sewer cannot be extended. It is limited by septic <br />fields. <br />Mark Chilton asked about the minimum lot size for septic fields and Craig Benedict explained <br />that it depends on the soil and that it is usually 40,OOQ square feet if it can be achieved. <br />Sometimes it is 2-4 acres. <br />Mark Chilton said that he does not want to permanently shut off people from what could be a <br />practical possibility. <br />Kevin Foy asked if the ETJ of Chapel Hill was a statutory issue. Craig Benedict said that it was <br />a request through the State for a defined limit to the Town's zoning authority. The boundaries <br />were determined by statute through the request of Chapel Hill. The lines are relatively fixed <br />until a request is made to the State. <br />Roger Waldan said that these ETJ lines have been there far 50 years. <br />Joal Hall Broun asked why that line was selected and Roger Waldon said that in the 1950's the <br />Town of Chapel Hill was growing beyond its corporate limits and the concept of ETJ was coming <br />into practice. It was the act of the State Legislature to draw the lines where they did. <br />Jim Ward said that he was aware historically about the Southern Small Area Plan but he was <br />not aware that there was some late information from this community which resulted in the <br />change of zoning to R-LD-1. He agrees with Mark Chilton in that he doubts this community was <br />notified sufficiently about this change. He would like to back away from this if possible, with this <br />new information, but he would like to honor commitments in good faith from the past council. <br />He would like to have good communication with this community. <br />
