oZa~~-o ~~ <br />~ ~,~~~ <br />NORTH CAROLINA <br />LICENSE AGREEMENT <br />AMENDMENT <br />ORANGE COUNTY <br />~ <br />THIS LICENSE AMENDMENT is made and entered into this ~ day of ,~,, 1 , 2012 by and between <br />ORANGE COUNTY (hereinafter referred to as "County") and ENO RIVER FARMERS MARKET, INC. <br />(hereinafter referred to as "Market"). <br />WITNESSETH: <br />THAT WHEREAS, the County and Market entered into a License Agreement dated May 14, 2009, for the use of <br />the Orange County Public Market House, since renamed the Farmers Market Pavilion, (hereinafter the "Original <br />Agreement"); and <br />WHEREAS, pursuant to the terms of the Original Agreement the license is set to expire March 31, 2012; and <br />WHEREAS, the County and Market desire to extend the Original Agreement, as extended, while keeping in effect <br />other terms and conditions of the Original Agreement not inconsistent with the terms and conditions set forth <br />below. <br />NOW THEREFORE, for and in consideration for the mutual covenants and agreements made herein, the parties <br />agree to extend the Original Agreement as follows: <br />The Term of the Original Agreement is hereby extended beginning April 1, 2012 through March 31, <br />2013. <br />Section One of the Original Agreement is amended to add a new subsection (D) Market shall not be <br />authorized to utilize the Farmers Market Pavilion during the Town of Hillsborough festival known as <br />Hog Day. Orange County shall notify Market of the date and time set for Hog Day with as much <br />advance notice as is practical. <br />Section Three of the Original Agreement is amended to read: Market shall pay County for this License <br />at the rate of $500.00 for the term of the April 1, 2012 through March 31, 2013 extension, as a lump <br />sum payable within 30 days of execution of this License Amendment. . <br />4. Except for the changes made herein, the Original Agreement shall remain in full force and effect to the <br />extent it is not inconsistent with this License Amendment.
