42 <br />16. Section 6.18.4 (Minimum Standards for Telecommunications Towers), Subsection f), <br />Paragraph 6 <br />Change to add (Staff): <br />c) Escrow Account. An escrow account of an amount determined by <br />the Board of County Commissioners shall be paid by check to <br />Orange County upon filing of a telecommunications tower <br />application. The account shall be drawn upon to pay associated <br />consultant review fees during the review process. Any unused funds <br />in the account after the approval of the Certificate of Occupancy (CO) <br />shall be returned to the designated party. <br />Administration Recommendation: Accept proposed Staff change <br />17. Section 6.18 (Telecommunications Facilities) <br />Change to add (Staff): <br />Commercial Impracticability or Commercially Impracticable — The inability, <br />to perform an act on terms that are reasonable in commerce; the cause or <br />occurrence of which could not have been reasonably anticipated or <br />foreseen and that jeopardizes the financial efficacy of the project. The <br />inability to achieve a satisfactory financial return on investment or profit, <br />standing alone, shall not deem a situation to be commercially impracticable <br />and shall not render a requirement of this ordinance commercially <br />impracticable. <br />Stealth or Stealth Technology — Technology or practice intended to . <br />minimize adverse aesthetic and visual impacts on the land, property, <br />buildings, and other facilities adjacent to, surrounding, and in generally the <br />same area as the requested location of such wireless telecommunications <br />facilities, which shall mean using the least visually and physically intrusive <br />facility that is not technologically or commercially impracticable under the <br />facts and circumstances. <br />Administration Recommendation: Accept proposed Staff change <br />
