ADMINISTRATION ORDINANCE 14 <br />7) Antennas may be located on poles <br />owned or controlled by the Count/ or by a utility provider <br />governmentally ftanehised utility poles (if appileable) G <br />poles GWRed by the Geu*ty pursuant to the following <br />regulations: <br />a) The maximum height of the pole with antenna of <br />d" shall not exceed seventy (70) feet in height; and <br />b) The utility poles shall be located on public property, <br />within public easements, or public rights -of -way. <br />C) The antenna afldief d+s# shall be of a size and <br />placement that is structurally compatible with the <br />engineering design of the pole pursuant to the North <br />Carolina State Building Code and attested to by a <br />professional engineer licensed in the State of North <br />Carolina <br />design, and competent to evaluate antenna choices. <br />d) The antenna GF dishes shall not extend more than <br />ten (10) feet above the existing pole height. If the <br />pole is replaced to withstand the addition of <br />telecommunications equipment, then the same <br />restriction shall apply except that the utility pole <br />may be twenty (20) feet higher than the adjacent pole <br />heights. <br />e) Placement of an antenna and/er-a -d on a utility <br />pole shall only be on poles owned or operated by a <br />public utility authorized to operate in the County, a <br />County franchisee, or Orange County. <br />Q All relocation costs associated with any relocation <br />of the antenna necessitated by roadway or sidewalk <br />improvements shall be borne by the <br />telecommunications provider. <br />f) Fees. <br />1) A filing fee as set by the Orange County Board of <br />Commissioners shall be paid upon application for a <br />Building Permit, Site Plan approval, or Special Use Permit. <br />In addition, an inspection fee is due the County at the time <br />of future inspections. <br />2) An engineering permit fee shall be paid if a pole is replaced <br />to accommodate telecommunications equipment. <br />3) Public land or right -of -way lease agreements will be <br />established by separate instrument. <br />
