LIMITATION OF LIABILITY: Except as vrovided in the foregoing INDEMNIFICATION, the liability of Norment for any claim of any <br />kind shall not exceed the value to date of payments actually received by Norment. In no event shall Norment be liable for any <br />special, indirect, incidental or consequential damages whatsoever. <br />EXCLUSIVE WARRANTY: THE WARRANTIES SET FORTH IN THIS EXTENDED WARRANTY ARE EXCLUSIVE AND IN <br />LIEU OF ALL OTHER WARRANTIES WHETHER STATUTORY, EXPRESS OR IMPLIED (INCLUDING ALL WARRANTIES <br />OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES ARISING FROM COURSE <br />OF DEALING OR USAGE OF TRADE). <br />TERMir1n'r~oN: Either party shall have the right to terminate their obligations under this extended warranty at the end of the term or <br />at the end of any subsequent one (1) year period provided that the party terminating the warranty shall provide ninety (90) days written <br />notice prior to the end of the then current term. Norment shall be paid in full for all work performed and costs incurred prior to the <br />date of termination. <br />GOVERNING LAW. This extended warranty shall be construed and enforced in accordance with the laws of the State of North <br />Carolina. <br />EN'r~ItETY oF AGxEEMEN'r: This proposal constitutes the entire and exclusive warranty for the services to be provided herein. The <br />proposal supersedes and otherwise renders null and void any prior written or oral agreements entered into with respect to the services <br />provided herein.
