SUPPLEMENTAL CQNTRAGT PROVISIONS FOR DVIISR~/ARRA FUNDiNG <br />By submission of a prapasal, Contractor agrees to comptywith the following pravisians. Fai{ure to complywith any <br />and al[ provisians herein may ba cause for the contraciing a~ency to issue a cancellation notice to a contracior. <br />Reporting Requirements <br />The Contractor is notified that #Mis project wilf be fin~nced with American Reco~rery and Re~nvestmenfAct of <br />20(?9 (hereinafter, "ARRA"') Funds. The Contractar shall ensure that aii subconfracts and other cantracts for <br />gotsds and services far an ARRA funded project haue the mandated provisions af this directive in their <br />contracts, Pursuant to Title XV, Section 1512 of the ARRA, the State shall require that the Con#ractor provide <br />reports and other emp(oyment information as evidence ta document the number of jobs created ar jobs retained <br />by this confiract from the Contractor's own warkforce and any sub-contractors. Na direct payment wiQ be made <br />for providing said repo~ts, as the cost far same shatl be includecl in the various items in the contract. <br />Pasting with the Laea! Errtployment Security Cammissian <br />In addifion to any other jab pastings the Contractor norma!!y utilizes, the Qffice of Ecanamic Recovery & <br />Investment {hereinafiter, "dERI") requires that the Contractor shafl post with #he lacal Employment Seau~ty <br />Cammission t7fifice a11 pasitions for whieh he intends to hire vsrorkers as a result of being awarded this contract. <br />Labor and semiskilfed pasifions must be past~d for at least 48 hours before the hiring decision. AI! other <br />pasitions must be posted a minimum posting of five days befare the hiring decisian. The Contractar and any <br />Suk~contractor shall report #he new hires in the manner prescribed by the Employment Security Carnmissi~n <br />and the OER1. <br />Required Cantract Pravision ta imp[ement ARRA Section 902 <br />Sectian 902 of the ,4RRA requires that each c~ntract awarded using ARRA funds rr-ust include a provision that <br />pravid~s the IJ.S. Comptroller Genera) and his representatives wsth the authority to: <br />(1} examine any recards of the contractac or any of its subcantrac#ars, ar any State or bca) agency <br />administering such contract, that directly perta[r~ to, and involve transactians relating to, the contract or <br />subcontract; a~d <br />(2) inferview any officer ar employee af #he cantractor or any of its subcontractors, ar of any 5tats ar la~ca) <br />government agency administering the contract, regarding such transactions. <br />accordingiy, the ~omptroller General and his tepresentatives shall have fhe autharity and rights prescribed under <br />Section 902 ofi the AR}ZAwith respectta cantracts funded wi#h recovery fiunds made availabte under the ARRA. <br />Section 9~2 furtherstaf~s that nothing in 902 shaq be interpreted to timit vr rastrict in ar~yway anyexisting authority <br />of #he Comptroller General. <br />Authcrrity of the tnsp~ctor General pravision <br />5ectian 1515(a) of the ARRA provides authority for any represen#atives of the United States Inspector Generat #o <br />examine any recards or interviewany employee ar offtcers working o n this cantract. The contractar is advised that <br />representatives of the Inspector General have the autharity to examine any record and interview any emplayee or <br />officer A#the contractor, its subcontractors ar o#herfirms working on this conteact. Sec#ion 1515(b) further provides <br />that nothing in this section shaEl b~ interpreted to iimit t~r restrict in any way any existing authority of an (nspector <br />General. <br />Buy American provisian <br />5ection 1605 ofithe ARRArequires that iron, steel and manufactt~red goods ~~sed in public buildings or publicworks <br />projec~.s be manufactured in the United States. Contractor agrees to abide by this provisian and shall maintain <br />records of such purchases for irtspections by authorized agents of the State of North Carolina and federal <br />ageneies.
