2 <br />Fox Hill Farm - Central Subdivision was approved by the Board of Commissioners on <br />December 11, 2001. On May 17, 2011, the Board of Commissioners approved a Revision <br />to the Resolution of Approval to address the mitigation of environmental conditions <br />discovered on a portion of the open space. The approval of this revision did not alter the <br />nature, scope, or location of the approved roadway and does not impact the request for Lee <br />Fox Lane to be accepted by NCDOT for maintenance purposes. <br />NCDOT has investigated these requests and has submitted petitions to the BOCC for its <br />recommendation (Attachment 2b). <br />3. Tanqlewood Acres Subdivision (E. Benton Drive) - Attachment 3a <br />The requested road addition is about 0.13 miles long. Three houses have entrances to the <br />road submitted for addition. Additionally, buses accessing A.L. Stanback Middle School <br />use the road to enter/exit the school property. E. Benton Drive is located about 0.6 miles <br />north of the intersection of NC 86 and New Hope Church Road. <br />Planning staff's research indicates that Tanglewood Acres was created prior to the <br />adoption of subdivision regulations in the Chapel Hill Township. The lots on E. Benton <br />Drive do not include the road right of way because all lots were created by deeds that <br />reference the intent for the adjacent road to be maintained by the state at a future time. <br />Per this intent, the road right of way is not currently owned by any of the property owners <br />with entrances along E. Benton Drive. <br />The NCDOT documentation on page 2 of form SR-1 does reference that the subdivision <br />was platted after October 1, 1975. However, this refers to a recombination platting and not <br />the original subdivision approval. NCDOT has recently investigated these requests and <br />has submitted petitions to the BOCC for its recommendation (Attachment 3b). <br />Conclusion <br />The above-referenced applications meet the criteria endorsed by the BOCC for <br />recommending acceptance of a public road into the State Maintained System for roads <br />approved through the governing jurisdiction's major subdivision process. <br />In accordance with North Carolina General Statute §136-62*, the Board is required to make <br />a recommendation regarding the petitions to the North Carolina Board of Transportation <br />(NCBOT) before NCDOT can consider the petitions. <br />FINANCIAL IMPACT: There is no direct financial impact to the County associated with this <br />item. NCDOT will incur additional maintenance responsibilities and costs. <br />RECOMMENDATION(S): The Manager recommends the Board: <br />A. Forward the Petitions for Addition to the State Maintained System to the North <br />Carolina Department of Transportation for subdivision roads in: <br />' North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to <br />present petitions to the board of county commissioners, and through the board to the Department of <br />Transportation, concerning additions to the system and improvement of roads. The board of county <br />commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their <br />recommendations." <br />
