0003 <br /> SCHOOL ADEQUATE PUBLIC FACILITIES ORDINANCE <br /> LIST OF AMENDMENT AREAS AND CONCERNS SINCE NOVEMBER 2000 <br /> The issues that have arisen from public and elected official comment are summarized as <br /> follows: <br /> 1. Educational Levels of Service (LOS): <br /> The percentage capacity for each school level both School Districts have remained the <br /> same and are included in the text of the Memorandum of Understanding(MOU): <br /> Elementary School Level 105% <br /> Middle School Level 107% <br /> High School Level 100% <br /> Recent(Spring 2002)comments have provoked evaluation of these percentages to ensure <br /> that upon initialization of the actual School Adequate Public Facilities Ordinance,the <br /> Educational Levels of Service is supported by the Capital Investment Plan so a "de facto" <br /> moratorium does not occur. <br /> 2. Memorandum of Understanding versus School Adequate Public Facilities Ordinance <br /> implementation: <br /> The Memorandum of Understanding now states that there are four variables to be agreed <br /> upon by all parties prior to the adoption of the actual ordinance: <br /> Section 1 c <br /> (i) Capital Improvement Program- (CIP) <br /> (a/k/a Capital Investment Plan); <br /> (ii) Projected growth rate for student membership at three levels for ten years; <br /> (iii) Methodology for projections; <br /> (iv) Student Generation Rate by generalized housing type. <br /> These determinations have been recommended by the Schools & Land Use Councils and <br /> are also in committee with the Schools Facilities Task Force. The initialization phase would <br /> include the above groups and, thereafter,the Memorandum of Understanding promotes a <br /> planning directors, school representatives technical advisory committee (PSTAC)to annually <br /> update the School Adequate Public Facilities Ordinance computer model and variables. <br /> 3. Timing of Certificate of Adequate Public Schools (CAPS) Issuance: <br /> The Certificate of Adequate Public Schools was originally scheduled to be given by the <br /> School District prior to submittal to the local government.
