Furthermore, it is not <br /> the responsibility of the board of education to "take ona <br /> ' developers when developments are stopped as the result of a CAPS <br /> denial. Since the planning government is ultimately responsible <br /> for the planning decision, any litigation related to the <br /> planning decision should follow a final administrative decision <br /> of the planning government. A final concern about the <br /> recommendation from the Schools and Land Use Councils on this <br /> point is that its proposal creates a never-ending loop. That is, <br /> there is no stopping point in the review by the planning <br /> government governing board of a CAPS denial decision. <br /> There is one other point of clarification in the MOU from <br /> that recommended by the Schools and Land Use Councils. The MOU <br /> recommended by the Board of County Commissioners calls for <br /> school district building capacity to be determined by joint <br /> action of the applicable Board of Education and the Orange <br /> County Board of Commissioners. These two governmental units <br /> partner in school facilities.
