November 19, 1985 BOCC Regular <br />Meeting Minutes Including Resolution <br />Adopting a Policy for Mutual <br />Assistance with Other Law <br />Enforcement Agencies <br />3. 6/2/08 Chatham County Resolution <br />Adopting a Policy for Mutual <br />Assistance with Other Law <br />Enforcement Agencies <br />PURPOSE: To approve the attached resolution updating the 1985 Resolution Adopting a Policy <br />for Mutual Assistance with Other Law enforcement Agencies, which allows the Sheriff's <br />Department to enter into mutual assistance agreements with other law enforcement agencies to <br />provide temporary assistance as needed. <br />BACKGROUND: North Carolina General Statutes §§ 160A-288 and 160A-288.2 allow county <br />law enforcement agencies to enter into mutual aid agreements with the Board of County <br />Commissioners' authorization. Once obtained, the Sheriff's Department may temporarily <br />provide assistance to another agency if the assistance is requested in writing by the head of the <br />other agency. The Sheriff's Department is then authorized to loan officers (including in an <br />undercover capacity), equipment, and supplies. <br />Although an officer on loan is subject to the lawful operational commands of superior officers in <br />the requesting agency, such officer remains under the control of his or her employing agency for <br />administrative and personnel purposes, including pay. <br />Given the reciprocal nature of any agreements into which the Sheriff enters, the Orange County <br />Sheriff's Department will benefit from the ability to request assistance as needed from other law <br />enforcement agencies. <br />
