10 (5uggested ~ormat) - RESC}LUTIOIV BY GOVERNING BODY ~F APPLlC~R,NT WHEREAS, The Federa) Clean Water Act Amendments nf 1987 and the Narth Carolina the Water Infrastructure Act af 2005 (NCGS 159Gj have autharized the making of foans and grants to aid eligibte units of government in financing the cost of construction of (state whether a wastewater treatment works, wastewater coliection system, stream restoration, stormwater treaCment, drinking water treatment works, and/or drinking water distribuiion system or other "green" project), and WHEREAS,. That the governing body of the Applicant agrees to inc[ude in the loan agreement a provision autharizing the State Treasurer, upan faiture of the (unit of government) to rnake schecfuled repayment of the loan, to withhotd from the (unit of government} any Stete funds that would otherwise be distributed to ihe focaf government unit in an amount sufficient to pay all sums then due and payable to the State as a repayment ofthe loan. ~ That the App(icant will provide far efficient operation and maintenance of the project on completion af constructian thereof.
