b <br /> MEMORANDUM OF UNDERSTANDING ��JJ//"" <br /> This Memorandum of Understanding ("MOU") entered into this thp�day of January, 2012 between <br /> Orange County, a local political subdivision of the State of North Carolina, ("County") and the Community Home <br /> .Trust, a not for profit corporation, ("CHT") for the continued access of Community Home Trust to the Orange <br /> County Employee Benefit Plans. <br /> Whereas, Orange Community Housing Corporation was created by the recommendation of Orange <br /> County's Low and Moderate Income Housing Task Force, of which the County is part, to sell and preserve <br /> affordable homes for low to moderate income families that live and work in Orange County;and <br /> Whereas, in October 1990 while Orange Community Housing Corporation was preparing to begin its first <br /> official year in operation and was searching for an Executive Director, they requested to be included in the <br /> County's Employee Benefit Plans for at least one year so they would have time to research other ways to provide <br /> these benefits to employees with the assistance of an executive director,and <br /> Whereas on October 16, 1990 the Orange County Board of Commissioners voted unanimously to <br /> provide access to one staff member of Orange Community Housing Corporation in the County Benefit Plans for <br /> at least one year;and <br /> Whereas, CHT has grown to eight (8) employees and the County has continued to allow CHT(formerly <br /> Orange Community Housing Corporation and Orange Community Housing and Land Trust)to "piggyback" on the <br /> County's Employee Benefit Plans over the years so long as CHT pays the cost of any premiums it utilizes so there <br /> is no direct cost to the County;and <br /> Whereas, the County and CHT desire to define the conditions under which CHT will continue to have <br /> access to the County's Employee Benefit Plans. <br /> NOW THEREFORE,the County and CHT agree to the following: <br /> 1. The County will continue to provide access to the County's Employee Benefit Plans for CHT <br /> employees. <br /> 2. CHT will pay the full cost of their benefit plan and no costs will be subsidized by Orange County. <br /> 3. CHT will continue to have access to the County's Employee Benefit Plans so long as there are no <br /> adverse effects on the County's premiums or Benefits Plans. <br /> 4. The County will review the effect of CRT's participation on the County's Employee Benefit Plans on <br /> an annual basis. <br /> 5. The Term of this MOU shall be January 1,2012 through December 31,2013. <br /> 6.
