If it is annexed, we have courtesy review. <br /> Commissioner Brown asked about the rezoning and how does this put the <br /> County Commissioners in joint planning in terms of the small area plan. She asked if it <br /> was true that the agreement in the joint planning area is of no value when it comes to <br /> either town's annexation interest. <br /> Geoffrey Gledhill said that the Northern study area and the plan that was <br /> adopted includes property that is in the extraterritorial planning jurisdiction of Carrboro <br /> and property in the transition area. With respect to the portion of the property that is <br /> located in the transition areas, the mixed use projects are jointly approved by Orange <br /> County and Carrboro. If Carrboro annexes property in the Northern Transition Area, <br /> then the joint approval of changes in zoning is gone. <br /> Commissioner Brown asked if there was any reference made in the small <br /> area plan that the County and Carrboro would work jointly on mixed use development. <br /> Geoffrey Gledhill said that at no time did the Northern Study Area address <br /> annexation. <br /> Commissioner Brown said that after rereading the Joint Planning Agreement <br /> and the small area plan, she realized that the presumption was so clear but unstated <br /> that this long process that the citizens went through developing the small area plan <br /> never even considered that Carrboro would go around the process by annexing, so it <br /> was never put in. <br /> Geoffrey Gledhill said that that is safe to say and that it is equally safe to say <br /> it would not have gotten in had someone proposed that annexation by Carrboro would <br /> result in a continuation of the joint planning process. <br /> Geoffrey Gledhill said that the answer to Commissioner Brown's second <br /> question is that the Joint Planning Agreement does prohibit annexation in the rural buffer <br /> and further prohibits Carrboro from annexing across into Chapel Hill's transition area and <br /> Chapel Hill from annexing into Carrboro's transition area. <br /> Commissioner Brown said that we are really dealing in good faith that Chapel <br /> Hill or Carrboro would want to have us work with them in any developments in the <br /> transition area, and if they do not, then it is basically a courtesy review or no review at <br /> all. <br /> Commissioner Brown asked about the memo concerning the urban services <br /> boundary. She said that she thought that Chapel Hill had specifically wanted this on our <br /> agenda to make some determination. <br /> Craig Benedict said that Chapel Hill did not say to put it on the public hearing, <br /> but to at least have something for the Assembly of Governments meeting in late <br /> October.
