A. Legal Advertisement for Joint Planning Public Hearing — October 9, <br /> 2002 The Board considered approving the legal advertisement for items to be <br /> presented at the joint planning area public hearing scheduled for October 9, 2002. <br /> Planning Director Craig Benedict summarized the information in the agenda <br /> abstract. The first item is anticipated to be the Carrboro Joint Planning Area/Transition <br /> Area Zoning Atlas Amendment. Tonight Carrboro is hearing this item to consider <br /> annexation of the property for Winmore development. If Carrboro does annex that <br /> property there will not be a joint planning public hearing on this item. <br /> The next item has to do with the Joint Planning Agreement itself. There was <br /> a 20-year provision concerning what areas could be annexed. <br /> The next item is a Joint Planning Agreement Refresher Course to let all <br /> boards and new members know what it is about and the intent of it. <br /> The next item is a non-joint planning public hearing item that has to do with <br /> Orange County only on fees. <br /> Craig Benedict made reference to a memo regarding Chapel Hill's <br /> Comprehensive Plan that mentioned a retraction of OWASA's urban service line. The <br /> retraction of this line has taken areas that were originally intended to be serviced with <br /> water and sewer. Chapel Hill was asked to review the implications of this and they are <br /> still doing so. At the October 30`h Assembly of Governments meeting, there will be a <br /> report from Chapel Hill to discuss the alternatives or the urban service line change. <br /> Chair Jacobs said that at the High School Planning Task Force meeting, <br /> when they discussed sites, two of the three sites that the Chapel Hill-Carrboro school <br /> system would like to consider are now outside the urban services area. <br /> Commissioner Gordon asked about the notice for the Joint Planning <br /> Agreement timeline. Craig Benedict pointed out page 3 under item 'b', the change in <br /> language was to 20 years instead of indefinitely. <br /> Geoffrey Gledhill said that the Joint Planning enabling legislation limits <br /> annexation agreements among the County and the Towns that do joint planning to 20 <br /> years. This is the reason for limiting it to 20 years. There are no time limits in the <br /> enabling legislation for the joint planning for other joint planning principles. <br /> Commissioner Gordon said that probably this should be included in the <br /> explanation when it is presented. <br /> Commissioner Carey made reference to the item about fees and when they <br /> would be determined and brought to the Board. Craig Benedict said that the fees would <br /> be based on a square footage basis so that a small house would pay smaller fees. After <br /> the public hearing, it would be brought back to the Board in November for review and an <br /> effective date could be January Vt. <br /> Commissioner Carey asked about the cause effect relationship between the <br /> position of the fees and the reduction of the insurance rates. <br /> Craig Benedict said that the Insurance Services Organization came to audit <br /> the Planning Department this year and they noticed that the amount of new activity for <br /> inspections is high for the amount of people in the department and they asked about <br /> their ability to continue the amount of inspections and doing a thorough plan review in <br /> order to maintain the existing insurance rating. ISO is coming back later this year to rate <br /> the department on the new plan review process, which has been implemented partially. <br /> The ISO comes every three years. <br /> Chair Jacobs asked about the latest time that the Board could approve this <br /> advertisement. <br /> Craig Benedict said that on September 25`h is goes to the paper, so it should <br /> be approved by the 20`h <br />
