As required by Section 7.8.1 (C) of the UDO, staff has determined the proposal <br />complies with County regulations requiring a coordinated street system while <br />protecting exiting natural features. <br />In staff's opinion, the road should not be extended any further east as it would <br />negatively impact identified stream buffers and floodplain. <br />d. As required by Section 7.8.2 of the UDO, staff has determined Woodkirk Lane has <br />been re-developed in ~ accordance with established NCDOT minimum roadway <br />standards and can be accepted for maintenance purposes. <br />e. The 9 lots along Woodkirk Lane cannot be further subdivided without going through <br />the major subdivision process as detailed within the UDO. The various properties are <br />still bound by the Declaration of Development Restrictions and Requirements <br />recorded within Deed Book 4212 Page 230 of the Registrar of Deeds. <br />FINANCIAL IMPACT: There is no direct financial impact to the County associated with this <br />item. NCDOT will incur additional maintenance responsibilities and costs. <br />RECOMMENDATION(S): The Planning Director recommends, and the Manager concurs, that <br />the Board: <br />a. Make an affirmative finding that the re-development of Woodkirk Lane into a public road <br />is consistent with the provisions of Section 7.8.1 and 7.8.2 of the UDO as recommended <br />by staff; and <br />b. Recommend sending the application to NCDOT for addition to the State Maintained <br />Secondary Road System. <br />
