Town of Hillsborough Renewal Request <br />2. 2010 Interlocal Agreement <br />INFORMATION CONTACT: <br />Terry Hackett, Stormwater Resource <br />Officer, 245-2588 <br />Ren Ivins, Erosion Control Supervisor, <br />245-2586 <br />Craig Benedict, Planning Director, <br />245-2592 <br />PURPOSE: To consider renewal of the Interlocal Agreement between the Town of Hillsborough <br />and Orange County to continue implementation of the stormwater and erosion control programs <br />for the Town by Planning 8~ Inspections' Erosion Control Division. <br />BACKGROUND: On December 6, 2010 the Board of County Commissioners approved an <br />updated Interlocal Agreement to continue implementation of the stormwater and erosion control <br />programs for the Town of Hillsborough by Planning & Inspections' Erosion Control Division. <br />The agreement is valid for five years, but it contains a provision that the agreement must be <br />renewed annually upon written consent of both parties. The Town of Hillsborough has provided <br />a letter requesting renewal of the agreement for the next permit year (See Attachment 1). <br />FINANCIAL IMPACT: Developer fees for erosion control are collected and retained by the <br />County to cover the erosion control duties listed in the agreement. The additional duties <br />required to implement the Town's stormwater program as outlined in the agreement are funded <br />solely through payment to the County by the Town. Payments from the Town are paid quarterly <br />as shown on Schedule A of the agreement (see Attachment 2). Total annual payment is <br />$80,000. As part of the approval of the agreement last year, a cost recovery analysis showed <br />that the collected fee is sufficient to offset staff time, overhead costs and cover equipment costs <br />needed to implement the program. No change in payment is proposed. <br />RECOMMENDATION(S): The Manager recommends the Board approve the one-year renewal <br />of the Interlocal Agreement and authorize the Manager to sign Attachment 1. Additionally, in <br />order to make the renewal process more efficient, the Manager recommends that the Board <br />allow the Manager to authorize future annual renewal terms of this agreement provided that <br />there is no change in scope of services or payment schedule. <br />
