19 <br />2 <br />The remainder of the watershed, approximately 19,979 acres, is developed at a <br />maximum 12% impervious surface limit. <br />Within this 4,000 acre area, high density residential development is limited to a <br />30% impervious surface limit while non-residential projects are allowed to develop <br />at a 70% impervious surface limit. <br />3. Unlike State regulations, Orange County requires the installation of BMP's for all <br />projects exceeding the 12% impervious surface limit threshold. <br />4. Under State regulations, the maximum level of allowable impervious surface area <br />for the Upper Eno Protected Watershed is 313,360,054 square feet or 30%. <br />Under County regulations, the maximum level of allowable impervious surface <br />area is 278,675,221.96 square feet or 26%. <br />While we may allow for a higher level of impervious surface area within the pre- <br />defined 4,000 acre urban area, County regulations still limit the overall impervious <br />surface area allowed within the watershed in excess of State regulations. <br />Staff believes that this argument is consistent with several provisions of the proposed <br />new rules allowing local communities to preserve `urban' levels of development in <br />identified areas. <br />E.
