FISCAL IMPACT <br />consideration and approval will not create the need for additional funding for the <br />provision of County services. Costs for the required legal advertisement will be paid <br />from FY2011-12 Departmental funds budgeted for this purpose. Existing Planning <br />staff included in the Departmental staffing budget will accomplish the work required <br />': to process this amendment. <br />D. AMENDMENT IMPLICATIONS <br />As required under Section 2.8.5 of the Unified Development Ordinance, the Planning <br />Director is required to: `cause an analysis to be made of the application and, based upon <br />that analysis, prepare a recommendation for consideration by the Planning Board and <br />the Board of County Commissioners'. <br />This amendment is necessary to incorporate State revisions to Neuse and Jordan Lake <br />basin standards and to clarify the areas where the County intends to have `high intensity' <br />and `low intensity' development to denote compliance with the intent and spirit of <br />proposed State modifications. <br />With respect to addressing concerns over limiting properties within the Upper Eno <br />Protected Watershed Overlay district to a maximum allotment of 30% impervious <br />surface area, staff has submitted a proposal to the State addressing this issue, the <br />substance of which is as follows: <br />1. Orange County's Planning program divides the watershed (i.e. Upper Eno <br />Protected) into `urbanizing' and `rural' areas. High density development, whether <br />it is residential or non-residential, is only permitted within apre-defined `urban' ', <br />area that is approximately 4,000 acres in size (approximately 16% of the <br />watershed). <br />_~___ ....__ ~ , _ _ ~~ __ _ _- _ -. ....__..~ __ _~ ~__ ._.._ _ __ ~ ~ __ __~ _.
