Planning Board and would not be returned to the Board of County Commissioners until approximately <br />November 20, 2001. <br />Commissioner Jacobs asked why the warding had to include "for private park purposes." Craig <br />Benedict said that he would discuss this with the County Attorney to work out the warding. <br />County Attorney Geoffrey Gledhill said that this is an application for a change from EC-5 to R-1, <br />which means that any use allowed in the R-1 district could be accomplished. This is not a special use <br />zoning. <br />Commissioner Jacobs would like to see the Planning Board and Board of County Commissioners <br />minutes from 1986 when this subdivision was approved. <br />Commissioner Gordon asked for a list of the pros and cons of going from EC-5 to R-1 or not. <br />Commissioner Brawn asked for the ultimate plan for the use of the property. Ann Joyner said that <br />they hope to use the lot to build a house. She said that the lot was not a park and never has been a park, but <br />a buffer around the EC-5, given the EC-5 use. Without the EC-5 use, there is no reason to have the open <br />space around it. She said that since 1986, they have been paying valuations on this properly as if it were an <br />R-1 lot. <br />Craig Benedict asked if the taxes had been assessed because there was an EC-5 on the lot. Ann <br />Joyner said that, according to the tax office the property was simply taxed as an R-1. She said that she was <br />going through the process that was advised to her in March, after asking since last October what she should <br />do. <br />James Selkirk, a member of the Planning Board, asked if the Planning Board was going to deal <br />with both questions -change in zoning from EC-5 to R-1 and the change in the subdivision regulations <br />removing the park designation. Craig Benedict said that the Planning Board would deal with both questions. <br />Geoffrey Gledhill said that the rezoning decision was a legislative one and none of the subdivision <br />history has anything to do with the decision about whether to rezone the property. He said that he would <br />send something in writing. The only question before the Board tonight is whether the change in the zoning <br />from EC-5 to R-1 is appropriate with respect to the zoning of land in Orange County. He further advised the <br />Board to ignore all of the history of this subdivision in making that decision. <br />Nicole Gooding-Ray said that it would seem prudent to take up the subdivision question after the <br />rezoning question. Geoffrey Gledhill said that he did not know whether you could build a house an lot 1 in the <br />area zoned R-1. <br />John Link volunteered to work with the County Attorney and the Planning staff to come forward <br />with a cogent proposal. <br />There were no comments from the public. <br />A motion was made by Commissioner Brawn, seconded by Commissioner Gordon to close the <br />public hearing. <br />VOTE: UNANIMOUS <br />A motion was made by Commissioner Jacobs, seconded by Commissioner Gordon to refer the <br />proposed amendments to the Planning Board for a recommendation to be returned to the Board of <br />Commissioners no sooner than November 20, 2001. <br />VOTE: UNANIMOUS <br />5.
