The apprcant shall incorporate provisions into the declaration o€ <br />restrictive covenants that effectively restricts and maintains the <br />common area open space. These protected areas shall be shown <br />and labeled accordingly on the Final Plat. The Section 7.11 of the UDO references the requires a minimum <br />recreation space ratio of 0.20 square feet of recreation space per <br />land area dedicated to residenfial use {0.20 * 6.917 acres = 't.383 <br />acres, or 60,260 square feet). In those-cases where-the regaired <br />minimum recreation space results in a larger amount than the <br />public recreation space requirement of 9/20 acre per lot {1/20 x 28 <br />lots = '1.4 acres or 60,984 square feet}, the difference shall be <br />established as private recreation space for the use of the residents <br />of the development (60,260 - 60,984 = no additional private open <br />space needed_ <br />Condition accepted by the applican4 <br />4. ~ Approximately 0.584 acres or 23,450 square feet of connected <br />MOA open space {6.50%} wi11 be pro#ected and available to <br />individual lot owners. <br />Coanditiose accepted by the applicant. <br />5. All haulers of construction waste shall be properly licensed.
