d. The application complied with submittal requirements (i.e. Sections 2.2 and 2.7) of the <br />UDO, <br />e. The application complied with the specific standards for the submission of a Conditional <br />Use (CU) application as detailed in Section 2.9.1 of the UDO, <br />f. The application complied with the specific standards governing the location of <br />Conditional Districts as detailed within Section 3.8.4 of the UDO, <br />g. The application contained sufficient information demonstrating compliance with the <br />specific regulations governing the development of Major Subdivisions as set forth in <br />Section(s) 5.15.6 and 7.14.6 of the UDO, <br />h. There was sufficient evidence entered into the record by the applicant demonstrating <br />compliance with Section 5.3.2 (B) of the UDO relating to the method and adequacy of <br />the provision of: <br />a. Sewage disposal facilities, <br />b. The adequacy of police, fire, and rescue squad protection, and <br />c. The adequacy of vehicular access to the site and traffic conditions around the <br />site <br />i. There was sufficient evidence and testimony within the record allowing for an <br />affirmative finding on the general findings of fact for this project (i.e. Section 5.3.2 (A) <br />(2)) of the UDO, and <br />j. There was insufficient evidence or testimony within the record demonstrating that the <br />applicant had not meet their burden of proof requiring the denial of the application. <br />Please refer to Attachment(s) 7 and 9 of this abstract for additional information. <br />FINANCIAL IMPACT: This request has been reviewed by various County departments who <br />have determined that the approval or denial of the request would not create the need for <br />additional funding for the provision of County services. <br />RECOMMENDATION(S): The Manager recommends the BOCC take the following actions: <br />1. Receive the Planning Board recommendation, <br />2. If necessary, deliberate further on the application, <br />3. Close the public hearing, <br />4. Review and approve the Resolution of Rezoning Approval contained within Attachment 7 <br />of the abstract, <br />5. Review the Special Use Permit Findings of Fact Sheet contained within Attachment 9 of <br />the abstract and affirm the findings of the Planning Board, as detailed therein, that the <br />applicant has demonstrated compliance with: <br />a. Specific standards for the submission of a Conditional Use (CU) application as <br />detailed in Section 2.9.1 of the UDO, <br />b. Specific standards for the submission of Special Use Permit applications as <br />outlined within Section(s) 2.2 and 2.7 of the UDO, <br />c. Standards governing the location of Conditional Districts as detailed within Section <br />3.8.4 of the UDO, <br />
