Please refer to Attachment 9, spec~cally sub-section I, Miscellaneous condition number 15, <br />for additional detail. <br />Staff has been informed by NC DOT that it will not assume maintenance responsibilities for <br />the sidewalk. <br />It should be noted that the topic of sidewalks in general, not specific to this project, is currently <br />scheduled to be discussed at the October 6, 2011 BOCC work session. <br />F. Pedestrian Open Space Access (POSA). The Planning Board has recommended a 5-foot <br />wide, mulched, POSA trail connecting the northern end of Tinnin Road to open space parcels <br />west of Road "B" as detailed on this site plan. <br />Applicant Response: The applicant has agreed to the condition. <br />G. Connection to Efland Cheeks Elementary School. Planning Board members encouraged the <br />applicant to ensure that a trail allowed for access to the Efland Cheeks Elementary School <br />and adjacent park. <br />Applicant Response: The applicant has agreed to the condition. <br />H. Re-configuration of the three (3) lots off of Tinnin Road. During the May 23, 2011 Quarterly <br />Public Hearing, BOCC members suggested that three lots off of Tinnin Road be re-designed <br />to provide additional open space and provide greater protection of identified wetlands. <br />Applicant Response: The applicant has modified the layout of the aforementioned lots to <br />address the concern. The Fire Marshal and the Solid Waste Department have reviewed the <br />access driveway for these lots and have approved its design. <br />I. Cul-de-sac radius. A concern was raised that the cul-de-sac denoted on the site plan should <br />comply with applicable NC DOT, Orange County Solid Waste, and Orange County <br />Emergency Services requirements. <br />Applicant Response: <br />i. The cul-de-sac has been modified accordingly. <br />ii. The 37' travelway with curb and gutter meets the NCDOT design standard. <br />iii. The County Solid Waste Department has reviewed and approved the design. <br />iv. As a result, the applicant has agreed to place "no parking" signs around the Road <br />"A" cul-de-sac. <br />Planning Board Recommendation: The Planning Board reviewed this item at its July 6 and <br />September 7, 2011 regular meeting and voted unanimously to recommend approval of the <br />application (i.e. rezoning and Class A Special Use Permit) finding that: <br />a. The applicant submitted sufficient evidence at the May 23, 2011 Quarterly Public Hearing <br />indicating that the rezoning petition was consistent with the requirements of the United <br />Development Ordinance (UDO), the 2030 Comprehensive Plan, and the Efland Mebane <br />Small Area Plan, <br />b. The project is in accordance with the anticipated densities for properties located within <br />the 10-year Transition Area as defined within the adopted Comprehensive Plan and <br />Urban Designated Areas as denoted on the Growth Management System Map, <br />c. The project is located within a Primary Service Area as denoted in the Water and <br />Sewer Management, Planning, and Boundary Agreement (WASMPBA), <br />
