- Adjourn the public hearing until October 18, 2011 in order to receive and accept the <br /> Planning Board's recommendation and any submitted written comments. <br /> There was no public comment. <br /> A motion was made by Commissioner Foushee, seconded by Commissioner Hemminger to <br /> receive the proposed amendments to the Unified Development Ordinance (UDO) as detailed in this <br /> abstract and attachments, refer the matter to the Planning Board with a request that a <br /> recommendation be retumed to the BOCC in time for the October 18, 2011 BOCC regular meeting, <br /> and adjourn the public hearing until October 18, 2011 in order to receive and accept the Planning <br /> Board's recommendation and any submitted written comments. <br /> VOTE: UNANIMOUS <br /> D. ADJOURNMENT OF PUBLIC HEARING <br /> A motion was made by Commissioner Yuhasz, seconded by Commissioner Hemminger <br /> to adjourn the quarterly public hearing at 7:39 P.M. <br /> VOTE: UNANIMOUS <br /> E. CLOSED SESSION - To establish, or to instruct the public body's staff or negotiating <br /> agents concerning the position to be taken by or on behalf of the public body in negotiating <br /> the price and other material terms of a contract or proposed contract for the acquisition of <br /> real property by purchase, option, exchange, or lease. (NCGS 143-318.11 (a) (5)) <br /> A motion was made by Commissioner Hemminger, seconded by Commissioner <br /> Foushee to adjourn the meeting into closed session at 7:39 p.m. for the purpose of "To <br /> establish, or to instruct the public body's staff or negotiating agents concerning the position to <br /> be taken by or on behalf of the public body in negotiating the price and other material terms of a <br /> contract or proposed contract for the acquisition of real property by purchase, option, exchange, <br /> or lease." (NCGS 143-318.11 (a) (5)) and, <br /> To consult with an attorney employed or retained by the public body in order to preserve the <br /> attorney client privilege between the attorney and the public body, which privilege is hereby <br /> acknowledged. NCGS 143-318.11(a)(3) <br /> VOTE: UNANIMOUS <br /> RECONVENE INTO REGULAR SESSION: <br /> A motion was made by Commissioner Hemminger, seconded by Commissioner <br /> Foushee to reconvene into regular session at 8:55 p.m. <br /> VOTE: UNANIMOUS <br /> ADJOURNMENT: <br /> A motion was made by Commissioner Jacobs, seconded by Commissioner Foushee to <br /> adjourn at 8:55 p.m. <br /> VOTE: UNANIMOUS <br />
