iv. Th ere was sufficient evidence and testimony within the record allowing for an <br />affirmative finding on the general findings of fact for this project (i.e. Section 5.3.2 (A) <br />(2)) of the UDO, and <br />v. There was insufficient evidence or testimony within the record demonstrating that the <br />applicant had not meet their burden of proof or requiring the denial of the application. <br />Please refer to Attachment 2 for a more in depth analysis. <br />It should be noted that both the staff and the Planning Board recommended the imposition of a <br />condition requiring the applicant: `... install any required septic system improvements necessary <br />to allow for the operation of the school from the property prior to the commencement of <br />activities' (see condition #5 on the last page of Attachment 2). On July 25, 2011 Orange County <br />Environmental Health issued an operations permit indicating that all work upgrading the septic <br />system had been completed and that school operations could commence. This condition is no <br />longer necessary and staff recommends that it be deleted. <br />Please refer to Attachment 6 for additional detail regarding the Environmental Health permit. <br />FINANCIAL IMPACT: This request has been reviewed by various County departments who <br />have determined that the approval or denial of the request would not create the need for <br />additional funding for the provision of County services. <br />RECOMMENDATION(S): The Manager recommends the BOCC take the following actions: <br />1. Receive the Planning Board recommendation, <br />2. If necessary, deliberate further on the application, <br />3. Close the public hearing, <br />4. Review the Special Use Permit Findings of Fact Sheet contained within Attachment 2 of <br />this abstract and make the appropriate findings that the application complies with the <br />various sections of the UDO, including the general findings as denoted within Section <br />5.3.2 (A) (2), and <br />5. Approve the Class A Special Use Permit and impose the conditions as recommended by <br />the Planning Board except for condition #5 on the last page of Attachment 2, as noted <br />above. <br />
