4 <br />~ ~ ~ 5. One right in/right out access entrance on Old NC 86 shall be <br />permitted. <br />6. A stub out to the south shall be constructed as indicated on the <br />November 3, 2003 site plan. Across-access easement <br />agreement shall be approved by the County Attorney's office <br />prior to recordation of Special Use Permit. <br />7. If any condition of this Special Use Permit shall be held invalid or <br />void, then this- Special Use Permit shall be void in it's entirety and <br />of no effect. <br />8. This Special Use Permit shall automatically expire within twelve <br />(12) months of the date of approval if the use has not <br />commenced or construction has not commenced. or proceeded <br />unless a timely application for extension of the time limit is <br />approved by the Board of County Commissioners as provided by <br />Section 8.4.11 of the Orange County Zoning Ordinance. <br />No decision on the application is made by either the Planning Board or <br />the Board of Commissioners at the public hearing. Instead, the <br />Planning Board has 3 regularly scheduled meetings within which to <br />prepare and submit a recommendation to the Board of Commissioners <br />or the Board of Commissioners may direct the Planning Board to <br />provide a recommendation by a date certain. Failure of the Planning <br />Board to submit a recommendation within the required time, the <br />application shall be forwarded to the Board of Commissioners without <br />a Planning Board recommendation. <br />FINANCIAL IMPACT: None determined. <br />RECOMMENDATION(S): Planning Staff Recommendation: Approval of the proposed <br />Zoning Atlas Amendment. rezoning the property from ED-LO-1 to <br />PD-ED-LNR. Approval of the Special Use Permit, Class A with <br />the conditions as listed above. <br />Administration Recommendation: Refer the proposed Zoning <br />Atlas Amendment and proposed Class A Special Use Permit to the <br />Planning Board for a recommendation to be returned to the Board <br />of County Commissioners no sooner than January 26, 2004. <br />
