SFY 205 Community Transportation Program <br />State NCDOT Certifications and Assurances <br />equivalent service set forth in 49 CFR 37.77(c), before purchasing non-accessible vehicles <br />for use in demand responsive service for the general public; <br />I. Applicant has established or will establish a procurement system, and has conducted or will <br />conduct its procurements in compliance with all applicable provisions of Federal laws, <br />executive orders, regulations, FTA Circular 4220.1 E, "Third Party Contracting <br />Requirements," as amended and revised, and other Federal requirements that maybe <br />applicable; <br />J. Applicant has complied or will comply with the requirement that its project provide for the <br />participation of private enterprise to the maximum extent feasible; <br />K. Applicant has paid or will pay just compensation under state or local law to each private <br />mass transportation company for its franchise or property acquired under the project; <br />L. Applicant has complied or will comply with all applicable lobbying requirements for each <br />application exceeding $100,000; <br />M. Applicant has complied or will comply with all applicable nonprocurement suspension and <br />debarment requirements; <br />N. Applicant has complied or will comply with all applicable bus testing requirements for new <br />bus models; <br />O. Applicant has complied or will comply with all applicable pre-award and post-delivery <br />review requirements; <br />P. Applicant has complied with or will comply with all assurances requires for prof ects <br />involving real property; <br />Q. Applicant has complied or will comply with applicable FTA and NCDOT Intelligent <br />Transportation Systems architecture requirements, to the extent required by FTA and <br />NCDOT;and <br />R. Applicant has complied or will comply with applicable prevention of alcohol misuse and <br />prohibited drug use program requirements, to the extent required by FTA and NCDOT. <br />14. North Carolina Department of Transportation Public Transportation Division <br />Vehicle Use <br />All vehicles purchased with State and/or Federal funds, including existing vehicles <br />and any vehicles purchased in the future, shall only be used for the provision of <br />public transportation services.
