Non - Residential Floor Area - a) Defined, Inclusions and Exclusions. Non - residential <br />floor area shall be construed as the sum of areas for non - residential use on all floors <br />of the building measured from the outside faces of the exterior walls, including halls, <br />lobbies, arcades, stairways, elevator shafts, enclosed porches and balconies, and <br />below -grade floor areas used for non - residential access and storages. Not countable <br />as floor area are: 1. Open terraces, .patios, atriums, or balconies. 2. Any residential <br />space. <br />Non - Residential Land Area - Non- residential land area shall be construed as all land <br />for non- residential development and related uses, including open space, within the <br />district in the case of locations which are controlled by these regulations. <br />Non - residential land area shall not be construed to include lands not beneficial to non- <br />residential use due to location or character, or areas used predominantly for <br />residential purposes. <br />Nursing Home - A facility, licensed by the appropriate state agency for the care of <br />aged or infirmed individuals, that meet the requirements set forth in this ordinance. <br />Amended <br />9116/03 Open Burning Of Trees, Limbs, Stumps And Construction Debris Associated <br />With The Permitted Activity -- shall be defined to be the disposal of limbs, stumps <br />and construction debris associated with the permitted activity by means of outdoor <br />fires. <br />Amended <br />10/13/99 Open Space - (flexible development) "Primary Conservation Areas" and "Secondary <br />Conservation Areas ", as defined in Section IV -B -10, C.2 of the Orange County <br />Subdivision Regulations, which are preserved through conservation easements or <br />other restrictions in a flexible development subdivision.. <br />Amended <br />10/13/99 Open Space - (land use intensity) 1) Open space is the total horizontal area of <br />uncovered open space plus half the total horizontal area of covered open space <br />subject to limitations set forth below. 2) Uncovered open space is total gross <br />residential land area not covered by buildings, plus open exterior balconies and roof <br />areas improved as recreation space. 3) Covered open space is usable open space <br />closed to the sky, but having two clear unobstructed open or partially open sides. <br />Partially open sides is to be construed as fifty percent or more. Examples of covered <br />space are covered balconies, covered portions of improved roof areas, or space under <br />buildings supported on columns or posts or cantilevered. The square footage <br />countable as covered open space shall not exceed the square footage of the open <br />space sides. <br />Open Space Measurement - (See Lot Line, Lot Line Front, Lot Line Rear, Lot Line <br />Side, Open Side, Open Space Front, Open Space Rear.) <br />Open Space Ratio - The minimum square footage of open space required for each <br />square foot of floor area. This area includes parking and vehicular access areas and <br />it can also include balconies, and roofs improved for recreation. <br />Outdoor Advertising Industry - The organizations that provide outdoor displays or <br />display space on a lease or rental basis. <br />22 -22 <br />
